The Bench comprised Justice Surya Kant, Justice Dipankar Datta, and Justice Vijay Bishnoi.
The officer, who had taken a leave of absence, failed to return on time and cited “back pain” as the reason for his extended stay at home.
He had submitted multiple leave extension applications rather than reporting back to duty.
Justice Surya Kant did not take the explanation lightly.
He sharply remarked:
“As a disciplined officer in a responsible force, you chose to stay home and repeatedly submit applications. And your reason—back pain? If back pain were a valid excuse, most Supreme Court and High Court judges would be on leave.”
Top Court not only highlights the court’s dissatisfaction with the officer’s behavior but also underscores the high expectations of discipline and accountability expected from personnel serving in the armed forces.
Case underscores the importance of duty and discipline in the military, and the court’s stand reiterates that flimsy excuses cannot justify dereliction of such crucial responsibilities.
