The Supreme Court heard Gitanjali Angmo’s petition challenging Ladakh activist Sonam Wangchuk’s detention under the National Security Act. Noting the urgency of the habeas corpus plea, the Court agreed to take up the matter day after tomorrow.
The Supreme Court of India heard a petition filed by Gitanjali Angmo, which challenges the detention of Ladakh-based activist Sonam Wangchuk under the National Security Act (NSA). The matter has once again brought the issue of preventive detention laws under judicial focus, especially in the context of habeas corpus petitions.
The case was listed before the apex court, but the hearing could not take place as scheduled. The Court deferred the matter after being informed that KM Nataraj, appearing for the Union government, was engaged in another case before a different Bench.
During the brief proceedings, the Additional Solicitor General informed the Court that
“there is no progress as of now; health concerns were raised and denied.”
This statement was made in response to submissions highlighting the circumstances surrounding Sonam Wangchuk’s detention and his physical condition while in custody.
The Bench took note of the seriousness of the plea, observing that the petition involves a habeas corpus challenge, which directly concerns personal liberty. Recognising the urgency attached to cases involving preventive detention, the Court recorded that
“Court noted the urgency of the habeas corpus plea and agreed to take it up day after tomorrow.”
The petition filed by Gitanjali Angmo questions the legality and constitutional validity of invoking the National Security Act against a prominent activist from Ladakh, and argues that such preventive detention requires strict judicial scrutiny.
With the Supreme Court agreeing to hear the matter shortly, the case is expected to once again test the balance between state power and individual liberty under India’s constitutional framework.
The hearing is now scheduled to be taken up day after tomorrow, when the Court is expected to examine the grounds of detention and the procedural safeguards mandated under law.
