NCP VS NCP: Supreme Court Criticizes Ajit Pawar's Faction for Misuse of Sharad Pawar's Name and Image

NEW DELHI: On Today(14th March),the Supreme Court has called upon the Nationalist Congress Party (NCP) faction led by Maharashtra’s Deputy Chief Minister, Ajit Pawar, to address allegations raised by the faction under Sharad Pawar. The allegations concern the unauthorized use of Sharad Pawar’s name and imagery for political leverage. This request from the judiciary underscores the ongoing strife within the NCP, spotlighting the legal and ethical considerations in political branding and identity.

A bench, including Justice Surya Kant and K V Viswanathan, mandated the Ajit Pawar faction to deliver a comprehensive response by the upcoming Saturday to the plea submitted by Sharad Pawar. The court emphasized the necessity for a “categorical and unconditional undertaking that the name, pictures of Sharad Pawar will not be used,” highlighting the gravity of the situation and the potential misuse of political symbols and personalities.

This judicial inquiry follows the Supreme Court’s maintenance of the Election Commission’s February 7 decision, which recognized the ‘Nationalist Congress Party-Sharadchandra Pawar’ as the official name for the Sharad Pawar faction, pending further review.

The confrontation is the Election Commission’s February 6 verdict, which acknowledged the Ajit Pawar-led faction as the legitimate NCP, awarding them the right to the party’s symbols and branding. This decision marked a pivotal moment in the ongoing factional battle within the NCP, rooted in Ajit Pawar’s July defection to the BJP-Shiv Sena alliance, which led to a significant rift within the party.

During the court proceedings, Sharad Pawar’s legal representative, Abhishek Manu Singhvi, expressed his concerns over the opposing faction’s use of the ‘clock’ symbol and Sharad Pawar’s images, labeling these actions as deceptive.

Singhvi’s remarks:

“This would be comic if it weren’t tragic for us. Free and fair elections are a part of democracy and the basic structure. If you have the guts, get your votes yourself. Why do you want to piggyback on our goodwill,”
