RG Kar Rape Case: Supreme Court Transfers Case to Calcutta HC; CBI Report Shared to Victim’s Father

NEW DELHI: The Supreme Court on Wednesday transferred the suo motu proceedings related to the RG Kar Medical College case to the Calcutta High Court, directing that an appropriate Division Bench monitor the matter. The Court also ordered that the CBI status report be furnished to the victim’s father, marking a significant development in the case involving alleged lapses in investigation and prosecution.

The matter was heard by a Bench comprising Justice MM Sundresh and Justice SC Sharma. During the hearing, Senior Advocate Karuna Nandy, appearing on behalf of nearly 50,000 doctors, informed the Court that she had taken instructions and emphasised the national importance of the issues involved.

Justice Sundresh observed,

“The matter can be referred to the High Court.”

Supporting this view, Solicitor General Tushar Mehta submitted that

“there were two aspects — the investigation and the prosecution.”

Justice Sundresh responded by stating,

“It would be appropriate for the High Court to monitor these aspects.”

Senior Advocate Karuna Nandy highlighted that the Supreme Court had earlier constituted a National Task Force (NTF), acknowledging the need for a broader national framework on medical professionals’ safety and well-being.

She submitted,

“This Court had earlier constituted a National Task Force (NTF) recognising the need for a national consensus.”

Nandy added,

“The NTF was meant to frame effective recommendations on safety and well being of medical professionals. I represent doctors from West Bengal.”

She further urged that the matter required limited judicial time, stating,

“Only one hearing is required. There is a single application.”

Nandy also pointed out that the CBI status report submitted to the Supreme Court raised serious concerns, noting,

“A CBI status report filed before this Court raises serious questions about involvement of others.”

Justice SC Sharma questioned the need for multiple forums to examine the issue, asking,

“Why should there be parallel proceedings?”

In response, Nandy suggested a procedural solution, stating,

“The status reports can be transmitted to the Calcutta High Court, with a copy provided to the victim’s father.”

Supreme Court’s Final Directions

Accepting the submissions, the Supreme Court passed a clear order transferring the case. The Court directed:

  • The suo motu proceedings be transferred to a Division Bench of the Calcutta High Court
  • The Chief Justice of the Calcutta High Court is to place the matter before an appropriate Bench
  • The CBI status report is to be furnished to the victim’s father

The order brings the focus back to the Calcutta High Court for closer monitoring of the investigation and prosecution, while ensuring transparency for the victim’s family.
