No oral mentioning will be allowed as the Supreme Court introduces a new system where all urgent cases get automatically listed within two working days. CJI Surya Kant’s major reform from December 1 aims to ensure faster and predictable access to justice.
Chief Justice of India Surya Kant implemented measures to streamline the listing of cases starting December 1, with new circulars issued regarding the listing and mentioning of cases.
The circular states that litigants no longer need to personally mention their cases before the bench for listing, as all fresh cases will be automatically listed.
It States,
“All fresh cases involving liberty of individuals and where urgent interim orders are sought for, where the case is verified, after curing of defects, will be listed within next two working days.”
To expedite the disposal of bail petitions, an advance copy must be provided to the respective Nodal Officer or Standing Counsel representing the Union of India, State, or Union Territory.
In cases of exceptionally urgent matters concerning anticipatory bail, death penalty, habeas corpus, eviction or dispossession, and demolition that cannot wait for the scheduled listing date, requests can be made between 10:00 a.m. and 10:30 a.m.
It adds,
“All other categories of fresh cases will be listed automatically as per existing practice. The fresh cases will be listed automatically and hitherto there shall be no necessity for the litigants to mention their case/s before the court for listing.”
Additionally, the circular states that no Senior Counsel will be allowed to make oral mentions before any court, while junior counsel may be encouraged to do so.
To facilitate the timely disposal of old regular hearing matters, no requests for adjournments of such cases will be accepted.
