The Supreme Court has sought the Centre’s response on a widow’s plea to bring back her son’s mortal remains from Dubai. The Court questioned the lack of details about his death and posted the matter for further hearing.
The Supreme Court of India on Friday sought responses from the Central government and other concerned authorities on a petition filed by a widow seeking help to bring back the mortal remains of her son from Dubai. The woman has approached the top court stating that her son, who had gone to Dubai for work, died there in December last year and his body has not yet been brought back to India.
A Bench comprising Justices Vikram Nath and Sandeep Mehta issued notice on the plea and listed the matter for further hearing on March 16. The Court has now asked the Centre and other respondents to file their replies.
During the hearing, the counsel appearing for the petitioner informed the Court that the woman is a widow and her son had travelled to Dubai to work as a labourer to support the family. The lawyer submitted that the family recently received information about his death.
“Now what is being informed is that he is dead,”
the counsel told the Bench, adding that the petitioner had received a call from the Indian embassy regarding the same.
On hearing this, the Bench questioned whether there was anyone known to the family in Dubai who could help in bringing the body back to India.
“You don’t know anybody else in Dubai who can bring it?”
the Bench asked.
The petitioner’s counsel replied,
“no”.
The Court then pointed out that the petition lacked specific details about the circumstances of the death. The judges observed,
“You have not given any details as t when did the death happen. How did he die? What happened there? You have just mentioned that there was a phone call on February 4 and you came to know,”
the bench said.
Seeking further clarity, the Bench directly asked,
“How did he die?”
In response, the counsel submitted that the petitioner does not have any information about the cause of death as there has been no further communication from the authorities. The mother is still unaware of the exact date and reason for her son’s death.
After hearing the submissions, the Court issued notice on the plea and sought responses from the Centre and other concerned authorities. The petition has requested the Court to direct the authorities to take necessary steps so that the mortal remains of the deceased can be brought back to India.

The mother has specifically sought assistance to enable her to perform the last rites and rituals of her son in accordance with her religious customs.
The matter will now be taken up on March 16, when the Court will consider the responses filed by the government and decide the next course of action.
