The matter followed after Singh’s comments on Prime Minister Narendra Modi’s academic qualifications. The bench comprising Justices BR Gavai and Sandeep Mehta rejected his appeal

The court upheld the summons issued by a trial court to Singh, dismissing his plea to quash the allegation. The defamation case names both Singh and Delhi Chief Minister Arvind Kejriwal as defendants.
Background
In March 2023, the Gujarat High Court ruled that the Prime Minister’s Office (PMO) was not obligated to disclose Modi’s degree certificates under the Right to Information Act (RTI Act). Following this ruling, Gujarat University filed a defamation complaint against Kejriwal and Singh for their criticism of the university’s reluctance to share the Prime Minister’s academic records. Consequently, a trial court issued summonses to both politicians in April of the same year.

AAP leader Sanjay Singh appealed the summonses issued to him, seeking relief from the Supreme Court.
The court declined to entertain Singh’s plea, stating,
“We are not inclined. Sorry.”
The Supreme Court emphasized that the observations made by the High Court should not influence the ongoing defamation trial against the accused politicians.

With the Supreme Court’s dismissal of Sanjay Singh’s appeal, the defamation case against him and Arvind Kejriwal will proceed in the trial court. The High Court previously stated that the right to free speech does not extend to defamation, emphasizing that the university constituted an identifiable group to file a defamation complaint.
