The Supreme Court has issued notice to the Centre on a fresh plea challenging a provision of the Digital Personal Data Protection Act, 2023 that allegedly restricts information obtained under the RTI Act.
The Court tagged the petition with similar pending cases and will hear the matter on March 23.
Today, On 16th February, The Supreme Court of India refused to stay the RTI Act amendment made through the Digital Personal Data Protection Act, 2023, and issued notice to the Centre on a plea challenging its constitutional validity.
The Supreme Court declined to direct the Centre to disclose the Leader of Opposition’s dissent note on appointments to the Central Information Commission. The Court stressed that its limited role is to ensure vacancies are filled and confirmed that all CIC posts have now been filled.
The Chhattisgarh High Court has ruled that complaints, service records, and inquiry details of judicial officers are personal information and cannot be disclosed under the RTI Act. The Court held that such disclosures lack public interest and are protected under Sections 8(1)(j) and 8(1)(e) of the RTI Act.
