[BREAKING] "Prepare a Module for Protection of Doctors": Delhi Medical Association Seeks to be Made Party in SC's Suo Motu of Rape & Murder of a Doctor

NEW DELHI: The Delhi Medical Association (DMA) approached the Supreme Court, seeking to become a party in a suo motu case concerning the tragic rape and murder of a postgraduate medical student at RG Kar Medical College and Hospital in Kolkata.

The association, representing over 15,000 doctors in the national capital, is advocating for the establishment of a committee led by a former Supreme Court judge to-

“prepare a module/scheme for protection of doctors and medical service personnel against any violence in the hospitals and the public healthcare centres.”

A Supreme Court bench headed by Chief Justice DY Chandrachud is slated to hear this case Today-Aug 20, with the matter being the first item on the agenda.

This hearing comes at a time when the nation is witnessing a widespread doctors’ strike in response to the horrific incident in Kolkata.

In its plea, settled by senior lawyer Vijay Hansaria and advocate Sneha Kalita, the DMA has suggested-

“The proposed committee should include representatives from the Indian Medical Association, the National Medical Commission, the Ministry of Health and Family Welfare, and law enforcement, alongside resident doctors from RG Kar Medical College, members of civil society, and such other person as this Hon’ble Court may deem fit and appropriate.”

The DMA has also recommended that, until the committee is formed and its report is submitted, the Supreme Court should direct each district’s superintendent of police to conduct threat perception assessments of government hospitals and deploy the necessary security forces.

They further urged the court to-

“Direct the Union of India to develop a software mechanism by way of distress call alert system in all healthcare institutions/establishments/college/facilities, which shall be available to all the doctors and all medical service personnel, especially the women, which will have live connectivity with nearby local police station and security staff of the hospital.”

Additionally, the DMA has called for all government healthcare facilities to ensure the proper functioning of CCTV cameras with direct linkage to a centralized police control room or any other suitable centralized agency.

They have also requested a mandate for the filing of an FIR within 24 hours of any such incident occurring within or near healthcare institutions.

The plea includes a request for a directive ensuring that

“no firearms or other weapons are allowed inside the healthcare medical institutions/establishments/colleges/such facilities. And creation of a compensation distress fund for the healthcare victim or the family members of the deceased victim.”

This case, which has triggered nationwide protests, revolves around the discovery of the junior doctor’s body, marked by severe injuries, in a seminar hall of the hospital’s chest department on August 9. The Kolkata Police arrested a civic volunteer the following day in connection with the case.

Subsequently, on August 13, the Calcutta High Court ordered the transfer of the investigation from the Kolkata Police to the Central Bureau of Investigation (CBI), which commenced its probe on August 14.

The high court’s decision to transfer the investigation to the CBI was made while hearing petitions, including one from the victim’s parents, who had requested a court-monitored investigation.
