Supreme Court Told Firecracker Ban Issues Overlap Across Benches, CJI To List MC Mehta Matter Monday

New Delhi: The Supreme Court was told that overlapping issues on the ban and regulation of firecrackers in Delhi-NCR are pending before different Benches, raising the possibility of conflicting orders, with Chief Justice of India Surya Kant saying the MC Mehta matter will be listed on Monday [M C Mehta v. Union of India].

Senior Advocate K Parameshwar mentioned the matter, which concerns crackers and Diwali, and submitted that Justice M M Sundresh had, in the last order, given liberty to mention it before the Chief Justice’s Bench. He pointed out that another matter is going on before Justice Sundresh, an all-India matter on whether there should be a complete ban.

What the Chief Justice said

The Chief Justice said the MC Mehta matter will be listed on Monday and indicated that the Court will also take up the overlapping issues together so that conflicting directions are avoided.

Why the development matters

With Diwali approaching, parallel proceedings on the same subject can produce inconsistent directions for manufacturers, sellers and enforcement agencies. Listing the connected matters together is meant to give a single, workable position on the right to clean air and the regulation of firecrackers.
