#BREAKING [Delhi Excise Scam] SC Extented Interim Bail of Businessman Abhishek Boinpally

The Supreme Court granted an extension to a businessman’s interim bail in connection with the Delhi excise policy case. The businessman, whose identity has not been disclosed, had sought relief related to the case.

NEW DELHI: Today (18th April): The Supreme Court extended the interim bail of businessman Abhishek Boinpally until May 8. Boinpally was granted five-week interim bail on March 20 in the Delhi excise policy case, and the extension was approved by a bench of Justices Sanjiv Khanna and Dipankar Datta.

The Enforcement Directorate (ED) did not oppose the decision, and senior advocate Kapil Sibal, representing Boinpally, mentioned the matter before the court. Last year, Boinpally filed an appeal against the denial of regular bail before the Delhi High Court.

Background

Abhishek Boinpally, 36, was arrested in October 2022 and is currently facing trial in the Delhi excise policy case, alongside former Delhi deputy chief minister Manish Sisodia. The charges against Boinpally include allegedly influencing the now-defunct 2021-22 Delhi excise policy, as well as being involved in a conspiracy to provide undue benefits to private liquor traders.

The Supreme Court granted interim bail to Boinpally on March 20, taking into account his medical problems during his incarceration. However, certain conditions were imposed, including surrendering his passport to the trial court and remaining in Delhi except for travel to his native Hyderabad. The court also authorized the trial court to impose necessary bail conditions to ensure the smooth progress of the ED’s ongoing investigation.

Boinpally previously obtained bail from the trial court in the Central Bureau of Investigation (CBI) matter related to the case. However, in November 2022, he was arrested by the Enforcement Directorate in connection with a money laundering probe associated with the same case. The ED has alleged that Boinpally is linked to proceeds of the crime amounting to Rs 105.55 crores, a claim which he vehemently denies, stating that it is based on uncorroborated statements from witnesses.

In his bail plea, Boinpally contended that the trial in the ED case is yet to commence, and the investigation against him is complete. He is seeking regular bail, which will be considered by the Supreme Court on May 8, along with his appeal against the Delhi High Court’s order.
