NEW DELHI: The Supreme Court today (11th Dec) has provided relief to Aam Aadmi Party leader Manish Sisodia by removing a specific bail condition in the Delhi Excise Policy case. This condition required him to appear before the Investigating Officers of the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI) twice weekly.
The decision was delivered by a bench comprising Justices BR Gavai and KV Viswanathan, with the Court emphasizing that Sisodia must consistently participate in the trial proceedings. The removed condition mandated Sisodia to report to the investigating officer every Monday and Thursday between 10:00 AM and 11:00 AM.
The bail was granted with the following conditions:
- Furnishing bail bonds amounting to Rs10,00,000, supported by two sureties of the same value.
- Surrendering his passport.
- Reporting to the Investigating Officer (IO) every Monday and Thursday between 10:00 AM and 11:00 AM.
Earlier, on August 9, the Supreme Court granted bail to Sisodia in cases filed by both the CBI and ED, citing the extended pre-trial custody and the delay in commencing the trial. The bail was granted on the condition that Sisodia furnish bail bonds of Rs10 lakh with two sureties, surrender his passport, and adhere to the aforementioned reporting requirement, which has now been waived.
Moreover, Former Delhi Deputy Chief Minister Manish Sisodia has filed a petition in the Delhi High Court, contesting the trial court’s decision to take cognizance of the Enforcement Directorate’s chargesheet in the Excise Policy case.
Sisodia’s plea argues that the chargesheet was submitted without obtaining the mandatory sanction approval from the competent authorities.
Background
Manish Sisodia was in custody from February 26, 2023, until he was granted bail in August 2024.
The case against Sisodia and other Aam Aadmi Party (AAP) leaders involves allegations of manipulating the Delhi Excise Policy to favor specific liquor vendors in return for bribes, allegedly used to fund the party’s election campaign in Goa.
Before securing bail, Sisodia had filed multiple applications, all of which were initially unsuccessful.
