Supreme Court Prepones Hearing To October 28 On Delhi SIR Plea Against Form 6 Declaration

Counsel for the applicants told the Supreme Court that 28 October might not help, and the CJI replied that the Court was thinking of passing an order to take care of the concern. The Court advanced to 28 October the hearing of an urgent application in the Delhi SIR matter against the Election Commission requirement that deleted voters file Form 6 with a first-time voter declaration.

New Delhi: Moving up the date by two days, the Supreme Court on Wednesday, 14 October 2026, preponed to 28 October the hearing on a Delhi SIR plea against Form 6 declaration, an urgent application in the Delhi Special Intensive Revision (SIR) matter. It challenges the Election Commission of India (ECI) requirement that voters deleted from Delhi’s electoral rolls submit Form 6 with a declaration that they have never voted before. The contentions are those of the applicants, and the Court has expressed no view on them [Application in the pending Delhi SIR petition against the Election Commission of India].

Advocate Prashant Bhushan mentioned the matter before a Bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi.

The exchange across the Bench

Before fixing a date, the CJI asked whether counsel had the number of the lead case. Mr Bhushan said notice had been issued for 30 October, and that the difficulty was that time would be expiring on that date. The Bench then advanced the hearing to 28 October. Mr Bhushan remarked that 28 October might not help, to which the CJI replied that the Court was thinking of passing an order which would take care of the concern. The text of any order has not yet been reported.

The applicants’ case for urgency

As Mr Bhushan put it, the Court had fixed 30 October in the main matter, and 30 October is also the last date for correcting deletions in the SIR. He contended that voters are being asked to fill up Form 6, which carries a declaration that they have never voted before, and that anyone filing a false declaration is liable to imprisonment. The applicants seek directions that the Election Commission must let such voters fill up Form A, which is meant for shifted voters, or create some other form. He asked that the application be taken up on Friday.

A deadline that meets the hearing date

The application turns on timing, since the last date for correcting deletions coincides with the date fixed in the main matter. The Court has now brought the hearing two days closer to that deadline, and counsel’s remark together with the CJI’s reply suggests that an interim order on the concern is under consideration. The Election Commission’s response is awaited.
