The Supreme Court Today (April 23rd) suspended the sentence of Congress MLA Mohammed Moquim in a corruption case.
Thank you for reading this post, don't forget to subscribe!NEW DELHI: The Supreme Court intervened in the case of Congress MLA Mohammed Moquim, who is embroiled in allegations of corruption, by temporarily suspending his sentence. This development followed an appeal from Moquim, challenging the decision upheld by the Orissa High Court.
Justices Surya Kant and Dipankar Datta, overseeing the proceedings, called for a review by the Odisha government. In their formal directive, they stated,
“Issue notice. Having heard the senior counsel for the parties and taking into consideration all the attending circumstances, the sentence of the petitioner is ordered to be suspended.”
This legal maneuver comes after the Orissa High Court, on April 10, dismissed Moquim’s appeal against a lower court’s judgment. The initial ruling was handed down by the Special Judge for Vigilance in Bhubaneswar on September 29, 2022.
Moquim, who held the position of managing director at Metro Builders Pvt Ltd, was found guilty in a corruption case involving the misappropriation of funds. Specifically, he was convicted of colluding with an IAS officer among others to improperly secure a financial benefit for his company.
This malfeasance was purportedly conducted under the guise of securing loans intended for the rural poor from the state-run Odisha Rural Housing & Development Corporation Ltd (ORHDC).
The lower vigilance court had sentenced Moquim to three years of rigorous imprisonment and imposed a fine of Rs 50,000. This sentence has now been put on hold pending further review by the Supreme Court, following their notice to the state government to respond to Moquim’s legal challenge.
