[2020 Clash with TMC Workers] “Ensures Trial May Commence, and Justice Is Done to the Parties”: SC Transfers 2 FIRs to CBI Against WB BJP Leader Kabir Shankar Bose

Today, On 4th December, The Supreme Court handed over two FIRs filed against a Bengal BJP leader to the CBI, stemming from a 2020 clash with TMC workers. The decision follows concerns over the impartiality of the local investigation. The FIRs involve allegations of violence and misconduct during the political altercation. This transfer underscores the judiciary’s intent to ensure a fair and unbiased probe.

New Delhi: The Supreme Court transferred two FIRs against West Bengal BJP leader Kabir Shankar Bose to the CBI.

These cases relate to a scuffle that occurred in 2020 between his security personnel and Trinamool Congress workers.

A bench comprising Justice B.V. Nagarathna and Justice Pankaj Mithal issued its ruling in response to a plea from Bose, who requested that the investigation be moved from the West Bengal Police to the CBI, a Special Investigation Team (SIT), or another independent agency.

The bench stated,

“In the peculiar facts of this case, a writ of mandamus is issued to the respondents to hand over the investigation papers pursuant to the two FIRs to the CBI along with all records for its completion so that if necessary, the trial may commence, and justice is done to the parties.”

Bose also sought a stay on the investigation and any further actions related to the FIRs filed against him by the West Bengal Police regarding the alleged altercation.

In his plea, he claimed that on December 6, he and his CISF guards faced a violent attack in Serampore, West Bengal, led by Santosh Kumar Singh, alias Pappu Singh, just outside his residence around 8 p.m.

He stated,

“As part of the protocol, CISF immediately secured the petitioner in a safe location and removed him from the spot. What ensued thereafter was protocol on the part of CISF to secure their protectee’s life, and the petitioner was not even present on the spot.”

Bose’s plea further noted that,

“Until 2 a.m., the entire building was under siege by over 200 TMC hooligans led by Kalyan Banerji, the sitting member of parliament for the area, actively supported by the state police.”

Kabir Shankar Bose is a notable leader of the Bharatiya Janata Party (BJP) in West Bengal, where he works as both an advocate and a political figure. In December 2020, he was involved in a confrontation between his security detail and members of the Trinamool Congress (TMC) in Serampore, resulting in two First Information Reports (FIRs) being filed against him. Bose has contested these allegations, claiming they are politically motivated.

In January 2021, the Supreme Court of India paused the proceedings, and on December 4, 2024, it transferred the investigation to the Central Bureau of Investigation (CBI) to ensure a fair and unbiased inquiry.
