NEW DELHI: At the Supreme Court, Chief Justice D.Y. Chandrachud was lauded for his leadership during a critical hearing that discussed the implications of private property rights under Article 39(b) of the Indian Constitution. The hearing, a culmination of decades-long deliberations that started back in 1992, focused on whether private properties could be reclassified as “community resources” and subject to state control for public benefit.

The nine-judge constitutional bench, led by Justice Chandrachud, wrapped up five days of intensive discussions and has reserved their judgment on the matter. The bench comprised Justices Hrishikesh Roy, B.V. Nagarathna, Sudhanshu Dhulia, J.B. Pardiwala, Manoj Mishra, Rajesh Bindal, Satish Chandra Sharma, and Augustine George Masih, showcasing a blend of experience and legal acumen.

The government was represented by Attorney General R. Venkataramani and Solicitor General Tushar Mehta, with senior advocates Jal T. Andhyarujina and Sameer Parekh presenting arguments on behalf of the appellants. The high-profile case has attracted significant attention, considering the potential reshaping of property rights in India.

An amusing and light-hearted moment punctuated the proceedings when a lawyer expressed gratitude, remarking,

“We are fortunate to argue before such a young and dynamic Chief Justice of India.”

This was warmly received in the courtroom, with Justice B.V. Nagarathna chiming in humorously,

“Oh, that’s a compliment!”

This interaction brought a moment of levity to the otherwise serious discussions, reflecting the congenial atmosphere fostered under Chief Justice Chandrachud’s stewardship.

The legal community and observers have closely monitored the bench’s review of 16 petitions, particularly the primary petition initiated by the Mumbai-based Property Owners Association in 1992. This case’s progression to a nine-judge bench, after preliminary reviews by smaller benches, underscores its constitutional significance and the broad implications it holds for the framework of property rights in India.

The decision, once announced, is expected to set a landmark precedent in how property rights are perceived and enforced in the country, reflecting the evolving dynamics between individual ownership and societal welfare.
