The action comes amid concerns that Chaubey has deliberately disregarded court directives.
Justice Surya Kant and PS Narasimha highlighted that Chaubey’s noncompliance appeared intentional and issued a stern warning that failure to appear before the Calcutta High Court could result in non-bailable warrants against him.
The High Court case in question stems from an election petition originally filed by Chaubey himself, contesting the electoral victory of the now-deceased Trinamool Congress candidate, Sadhan Pande, in West Bengal’s Maniktala constituency during the 2021 assembly elections.
“We are satisfied that he is defying court orders wilfully. Non bailable warrants will be issued if he does not remain present before the High Court,”
-the Justices stated.
The Supreme Court was considering a petition brought by three residents of the Maniktala constituency, who expressed concerns that their representation had been inadequate for years due to ongoing legal disputes.
Senior Advocates Mukul Rohatgi and Devadatt Kamat, representing the petitioners, argued that Chaubey had consistently delayed his court appearances, citing various excuses and his official responsibilities.
This behavior prompted the Supreme Court to reiterate that Chaubey was willfully ignoring a previous Supreme Court order from August 2023, which had urged the Calcutta High Court to expedite proceedings in the election petition.
The court’s response underscores the judiciary’s growing impatience with Chaubey’s disregard for legal processes and mandates.
