NEW DELHI: The Supreme Court on Friday scheduled the hearing for November 25, 2025, in a case seeking the removal of an AI-generated video posted by the BJP’s Assam unit on the social media platform X. The video allegedly depicts a communal narrative suggesting a “Muslim takeover” of Assam if the BJP were to lose upcoming state elections.

The matter was mentioned before a Bench comprising Justices Vikram Nath and Sandeep Mehta by Advocate Nizam Pasha, who sought urgent listing of the plea, reminding the Court that it had earlier issued notice in the case.

“Assam video matter… it didn’t come… please list. Notice was issued,” Pasha submitted.

The Bench accordingly fixed the hearing for November 25.

Background of the Case

The plea, filed as part of Writ Petition (No. 24/2022), challenges a video that was posted on September 15, 2025, on the official X handle of BJP Assam Pradesh. The AI-generated clip purportedly shows Muslim individuals taking over key landmarks in Assam, including tea estates, Guwahati Airport, Rang Ghar, and government lands.

The petitioners, represented by Advocate-on-Record Lzafeer Ahmad BF, argue that the video promotes communal disharmony and vilifies the Muslim community, thereby violating constitutional principles of secularism and equality.

As per the petition, the video has been viewed over 4.6 million times, liked 19,000 times, and reposted 6,100 times within days of being uploaded. Petitioners assert that the content poses a serious risk of inflaming communal tensions in a state known for its delicate demographic balance.

Petitioners’ Arguments

The plea contends that the BJP-Assam unit, as part of a ruling political party, bears a constitutional duty to uphold secularism rather than propagate divisive narratives. It states:

“BJP-Assam is bound by the Constitution of India and thereby is bound to uphold the secular values that form part of the basic structure of the Constitution. However, the video circulated by its official Twitter openly targets, vilifies, and demonizes Muslims.”

It further argues that the core message of the video is that a “Muslim takeover” represents the worst possible fate for Assam, and that voting for the BJP is presented as the only way to prevent such an outcome, a claim the petitioners describe as “divisive propaganda.”

The plea also highlights that state governments and ruling parties are constitutionally prohibited from discrimination on religious or communal grounds, and that even private citizens are barred by law from spreading communal disharmony or hatred.

The petition seeks immediate directions to X India Pvt. Ltd. and the BJP Assam Pradesh to take down the AI-generated video. It also calls for penal action against those responsible for creating and disseminating the content, in order to prevent further spread of communal unrest and enmity.

Earlier, on October 7, 2025, the Supreme Court had issued notice on the application but had not taken it up for hearing since. With the matter now listed for November 25, legal experts note that the case could set an important precedent regarding AI-generated political propaganda, misinformation, and communal content regulation on social media.
