The mother of Atul Subhash, the Bengaluru engineer who died by suicide on December 9, has approached the Supreme Court seeking custody of her four-year-old grandson. Anju Modi has filed a habeas corpus petition to secure the custody of her grandson whose whereabouts are unknown. The petition claims that neither Subhash’s estranged wife Nikita Singhania, nor her family members – currently in custody – have disclosed the child’s whereabouts.

Subhash left behind both video and written notes, alleging harassment and false accusations by his wife, Nikita Singhania, and her family. In her habeas corpus petition, Anju Modi requested the court to intervene and help locate the missing child.
Anju Modi’s petition claims that neither Subhash’s estranged wife, Nikita, nor her family members-currently under judicial custody, have disclosed any information about the child’s whereabouts.
Nikita reportedly informed the police that the boy was studying at a Faridabad boarding school and was under the care of her uncle, Sushil Singhania. However, Sushil denied any knowledge of the child’s location, adding to the uncertainty.
A bench comprising Justice BV Nagarathna and Justice N Kotiswar Singh issued notices to the state governments of Uttar Pradesh, Haryana, and Karnataka, asking them to clarify the situation.
The court has scheduled the next hearing for January 7.
The case has already resulted in multiple arrests. Nikita Singhania, along with her mother Nisha Singhania and brother Anurag Singhania, was arrested on December 16. The Karnataka Police charged them with abetment of suicide based on the evidence found in Subhash’s notes and video messages. Currently, they are in judicial custody.
According to the petition filed by Anju Modi, the Singhania family has allegedly hindered efforts to find the child. Subhash’s father, Pawan Kumar, has also publicly demanded custody of his grandson.
The Singhania family is not backing down. Senior counsel Manish Tiwary appeared in the Allahabad High Court to seek anticipatory bail for Nikita’s uncle, Sushil Singhania. Citing his advanced age (69 years) and chronic health issues, Tiwary argued that the charges of abetment were exaggerated and amounted to harassment at most.
Justice Ashutosh Srivastava granted Sushil Singhania pre-arrest bail under strict conditions, including a personal bond of Rs 50,000, mandatory availability for police questioning, and surrender of his passport.
The Subhash family has accused Nikita and her family of harassing Atul with false legal cases and monetary demands, which they believe led to his tragic decision.
Pawan Kumar and his son Bikas Kumar have vowed not to immerse Atul’s ashes until justice is served.
“The others behind this incident should also be arrested. We will not get justice till all false cases registered against us are withdrawn. We will not immerse the ashes of my brother till we get justice. Our fight will continue,”
-Bikas Kumar stated firmly.
The family is also deeply worried about the missing child’s safety.
“I am equally concerned about my nephew (son of Subhash). His safety is a matter of serious concern for us. We have not seen him in recent photographs. I want to know his whereabouts through the media. We want his custody as early as possible,”
-Bikas Kumar added.
