Supreme Court Quashes Appointment of 2 MLCs Under Governor’s Quota in Telangana

The Supreme Court quashed the Telangana government’s appointment of Prof. M. Kodandaram and Amir Ali Khan as Members of the Legislative Council under the Governor’s quota, ruling the selection process invalid and contrary to constitutional provisions.

New Delhi: The Supreme Court dealt a major drawback to the Telangana government by nullifying the appointments of Prof. M. Kodandaram and Amir Ali Khan as Members of the Legislative Council (MLCs) under the Governor’s quota.

This ruling follows an extended legal dispute regarding their nominations.

The decision effectively removes both individuals from their positions and is the result of a petition filed by Dasoju Sravan and Satyanarayana.

The petitioners contended that the appointments violated established norms for Governor’s quota nominations, which are meant for individuals with notable accomplishments in areas such as literature, science, art, and social service.

Prof. Kodandaram, a prominent political analyst and founder of the Telangana Jana Samithi (TJS), and Amir Ali Khan, editor of the Urdu daily The Siasat Daily, were initially nominated to the Legislative Council by the state government.

Although the Telangana High Court had initially quashed the appointments, the Supreme Court had stayed that order, allowing them to remain in their roles until today’s final ruling.

The Supreme Court’s verdict has reignited discussions about the nomination process for the Legislative Council under the Governor’s quota. The court’s decision highlights the necessity for these nominations to strictly adhere to the established criteria.

The next hearing in this case is set for September 17, which may offer further clarity on the future actions for all parties involved.
