The notices, facilitated by Delhi-based Rizwan Law Associates, highlight multiple grievances, including the poor quality of the apartment delivered and the unauthorized use of Singh’s image for promotional activities.
The first notice targets M/s Brilliant Etoile Private Limited and M/s Uppal Housing Private Limited for not providing possession of an apartment on time. The notice emphasizes that the apartment promised as ‘premium quality’ was of substantially lower standard than agreed. Singh is seeking adequate damages for the delay and the diminished quality of the apartment, booked back in 2020 in Hauz Khas, New Delhi.
The second legal notice is directed solely at Brilliant Etoile Private Limited. It accuses the firm of violating Singh’s personality rights and misusing his brand value post the expiration of a Memorandum of Understanding (MoU) signed on November 24, 2020. Despite the MoU expiring on November 23, 2023, the firm allegedly continued using Singh’s images for commercial gains on billboards, social media posts, and other promotional materials without his consent.
Singh has expressed significant distress over the misuse of his personal brand and the unauthorized commercial use of his likeness.
He claims this infringes on his copyright, personality rights, and right to publicity as protected under intellectual property rights law.
“The unauthorized commercial use of my likeness is a violation of my personality rights and right to publicity,”
-Singh stated.
Through these legal notices, Yuvraj Singh aims to address the grievances related to delayed possession and privacy infringement. He seeks compensation for the substandard quality of the delivered apartment and damages for the unauthorized use of his image. The legal action underscores the importance of adhering to contractual agreements and respecting personal rights in commercial activities.
Yuvraj Singh’s legal action against the real estate firms serves as a reminder of the critical importance of fulfilling contractual obligations and respecting individual privacy rights. The case highlights the challenges faced by consumers in the real estate sector and the need for stringent measures to protect their interests. Singh’s decision to pursue legal recourse reflects his commitment to safeguarding his rights and holding companies accountable for their actions.
