This decision highlights the ongoing infrastructure challenges faced by trial courts and tribunals in the country.
On May 21, a bench consisting of President Suresh Kumar Gupta and members Harshali Kaur and Ramesh Chand Yadav observed the severe conditions in the courtroom. The order stated,
“There is neither Air Conditioner nor Cooler in the Court Room. Temperature is more than 40 Degree Celsius. There is too much heat in the Court room which led to sweating as such it is difficult to hear arguments.”
The court noted that the sweltering heat made it impossible to conduct hearings effectively. The bench also pointed out the lack of basic facilities, adding,
“Moreover, there is no water even to use the washroom.”
Given these harsh conditions, the court decided that it was not feasible to hear the arguments of the parties involved and subsequently adjourned the matter to November 21.
The court also directed that a copy of the present order be sent to the Secretary-Cum-Commissioner for information.
This situation sheds light on the broader issue of inadequate infrastructure in courts, particularly in trial courts and tribunals. The national capital is no exception, with various district courts and tribunals facing similar challenges.
The lack of proper facilities in these judicial institutions hampers the effective dispensation of justice, underlining the urgent need for infrastructural improvements.
