Lucknow court upheld the dismissal of Amitabh Thakur’s defamation complaint against CM Yogi Adityanath. The court ruled that the term ‘Kathmullapan’ used in a Legislative Council speech does not amount to defamation.
Lucknow: Today, On May 20, A court in Lucknow, Uttar Pradesh has confirmed the earlier decision made by the Chief Judicial Magistrate (CJM) Court to reject a defamation case filed by Amitabh Thakur against the Chief Minister, Yogi Adityanath.
This case was about the Chief Minister’s use of the word “Kathmullapan” in a speech given in the Legislative Council in February of this year.

The court carefully examined the complaint and the arguments from both sides.
Amitabh Thakur had accused Yogi Adityanath of harming his reputation by using the term “Kathmullapan,” which Thakur believed was offensive and defamatory.
However, the court found no sufficient grounds to consider the speech as defamation. It agreed with the earlier judgment given by the CJM Court, which had already dismissed the complaint.
The court’s decision means that the use of the word in a political speech, especially inside the Legislative Council, does not amount to defamation in this case.
The judgment highlights the protection given to freedom of speech in political settings, as long as it does not cross legal limits.
The court stated,
“The complaint does not disclose any offence punishable under the law.”
It further mentioned that political leaders have the right to express themselves during legislative sessions and such expressions should not be treated lightly in defamation cases.

This ruling is important because it clarifies the boundaries between free speech and defamation when it comes to political statements made in official forums like the Legislative Council.

It also sends a message about the judicial approach towards complaints arising from political expressions.
