Mumbai Court Denies Uddhav Thackeray and Sanjay Raut’s Plea in Defamation Case by MP Rahul Shewale

In a significant development, a Mumbai magistrate’s court has denied the discharge plea of Shiv Sena (UBT) chief Uddhav Thackeray and MP Sanjay Raut in a criminal defamation case initiated by MP Rahul Shewale. The case revolves around an article published in the Shiv Sena mouthpiece ‘Saamana’ on December 29, 2022. Thackeray holds the position of chief editor, while Raut is the executive editor of the publication.

Shewale, representing Mumbai’s south-central constituency from a rebel Shiv Sena faction led by Chief Minister Eknath Shinde, took legal action against the duo, alleging that the said article was defamatory. The article in question, as per Shewale’s complaint, insinuated that he had undisclosed business interests in Karachi, Pakistan. The complaint, articulated by Shewale’s lawyer Chitra Salunkhe, stated,

“The bare perusal of the said articles alleges that complainant has certain undisclosed assets in the neighbouring country which have been acquired through wrongful means by him, which is a very serious allegation against a public figure, having the ability to affect his political career awfully.”

Shewale vehemently denied the allegations, emphasizing that the article was a “concocted story” and a prime example of “vendetta journalism.” He further asserted that the allegations were a mere attempt to tarnish his reputation and political standing. The complaint highlighted,

“The ramifications of such fake allegations are drastic and can alter the course of one’s personal or political life acutely.”

The complaint also shed light on Shewale’s political journey, noting that the Shiv Sena had entrusted him with significant responsibilities for nearly two decades. However, after his departure from the party and subsequent association with the BSS (Balasahebanchi Shiv Sena) led by state chief minister Eknath Shinde, he faced unwarranted criticism, especially from supporters of the Uddhav Thackeray-led Shiv Sena.

In their defense, Thackeray and Raut maintained their innocence, contending they had no direct involvement in the selection of articles for ‘Saamana’. They emphasized that the Assistant editor, Atul Joshi, was responsible for overseeing the selection process.

The court has adjourned the matter to November 9 for the recording of evidence.
