Can the family of the man killed in the Kochi Mercedes crash be heard when the State seeks to cancel a 17-year-old accused’s bail? His wife has asked a Sessions Court to let her join the plea. The allegations are untested.

Kochi: Before the Ernakulam Sessions Court, the wife of the 55-year-old scooter rider killed in the Kochi Mercedes-Benz crash has filed an application to be impleaded in the State’s plea against the bail granted to the minor accused [State of Kerala v. Child in Conflict with Law].
The Juvenile Justice Board, Ernakulam, had granted the 17-year-old bail on Monday, and the State has challenged that order. The impleadment application was filed on Wednesday and is pending. Because the accused is a juvenile, neither he nor his family is named here. The allegations against him are untested, the Court has expressed no view on the merits, and he is presumed innocent.
The question the application raises
Bail granted to a child in conflict with law by the Juvenile Justice Board can be challenged in appeal before the Children’s Court, and the State has gone to the Sessions Court on that footing. What the wife’s application now puts in issue is whether a victim’s family may be heard as a party in such a challenge. The Court’s decision on it is awaited, and no order on the application has been reported so far.
The crash and the protest over bail
At about 2.20 am on a Sunday, near Container Road in Cheranalloor, Kochi, a Mercedes-Benz allegedly driven by the minor hit a scooter, and its rider, who ran a roadside eatery, died. The police booked the minor under Sections 281 and 106(1) of the Bharatiya Nyaya Sanhita, 2023, for rash driving and causing death by negligence, and later added a charge of culpable homicide not amounting to murder.
The Juvenile Justice Board released him on bail under the Juvenile Justice (Care and Protection of Children) Act, 2015. The victim’s family and local residents then protested against the bail outside the Cheranalloor police station.
Proceedings running alongside
The minor’s father, a judicial officer, has been made an accused under Section 199A of the Motor Vehicles Act, 1988, as the registered owner of the car. Separately, the victim’s children have complained to the Chief Justice of the Kerala High Court, and the Court’s Administrative Committee has decided to await further material from the police investigation before acting on that complaint.
