Kerala MLA Rahul Mamkootathil Gets Anticipatory Bail in Second Rape Case After 2-Year Delay Claim

A Thiruvananthapuram court granted anticipatory bail to MLA Rahul Mamkootathil in a second rape case, noting his claims of political motive and delayed complaint. The Crime Branch registered the case after the complainant’s email was forwarded by the KPCC President.

A Kerala court on Wednesday granted anticipatory bail to MLA Rahul Mamkootathil in the second rape case registered against him. The order was passed by Thiruvananthapuram Sessions Court Judge Nazeera S, who allowed Mamkootathil’s plea seeking protection from arrest.

Earlier, the same court had rejected his request for anticipatory bail in another rape case pending against him.

The latest case was registered after KPCC President Sunny Joseph forwarded an email written by the complainant to the State Police Chief.

In her email, the woman accused Mamkootathil of raping her in 2023 after calling her to a resort under the false promise of discussing a marriage proposal.

She said that Rahul Mamkootathil got her Telegram contact, convinced her to meet to talk about “future plans,” and then took her to an isolated homestay with his friend. She alleged that he assaulted and raped her there, causing multiple injuries.

Based on the forwarded complaint, the Crime Branch registered the case and began its investigation.

In his anticipatory bail plea, Mamkootathil said that the accusations are false and politically motivated. He argued that there is no material evidence to prove the allegations and that the case was filed only to damage his reputation.

He also highlighted that the woman waited almost two years to report the alleged incident. His plea stated:

“It is submitted that there is a delay of two years in reporting the offence. Even now, the defacto complainant has not made any complaint to any law enforcing authorities. She stated vague reasons in the in Exhibit P2 for that. If the allegation is genuine, the defacto complainant has the opportunity to approach the police instead of approaching the KPCC, President.”

Mamkootathil also questioned the credibility of the email, saying that it did not mention the exact date, location, or even the identity of the complainant. He assured the court that he would fully cooperate with the investigation and follow any conditions imposed by the court.

He added that custodial interrogation is unnecessary and that an arrest at this stage would cause serious harm to his public image and political career.

The Congress party had suspended him in August after multiple women made allegations of sexual misconduct.

He resigned as Youth Congress Chief and was expelled from the party last week. However, he continues to serve as the MLA representing Palakkad constituency. In the first rape case registered against him, the Kerala High Court has already stayed his arrest.

Senior counsel Sasthamangalam Ajithkumar and advocate Sekhar G Thampi represented Mamkootathil in the proceedings.
