Delhi Rohini Court Fines Defendant Rs. 30,000 for Non-appearance in Cheating Case

On February 22, the Delhi Rohini court imposed a fine of Rs. 30,000 on a defendant who repeatedly avoided appearing forin a cheating case. The case, registered in 2019 against Sanjeev Chadha at Keshav Puram police station, has progressed to arguments on charges. Metropolitan Magistrate Divya Arora, referencing a directive from the Delhi High Court, criticized Chadha’s habit of evading physical appearances despite being offered video conferencing options. The court deemed Chadha’s behavior an abuse of legal process and imposed the fine, with further proceedings scheduled for April 5th.

NEW DELHI: On February 22, the Delhi Rohini Court fined a defendant Rs. 30,000 for repeatedly missing court appearances related to a cheating case.

Metropolitan Magistrate Divya Arora referenced a significant directive from the Delhi Rohini Court issued on December 13, 2023. According to this directive, Chadha was required to appear in person before the court and apologize unconditionally for causing inconvenience due to his persistent absence. The Court also instructed the trial court to proceed with the case.

The case, dating back to 2019, involves Sanjeev Chadha and was filed at Keshav Puram police station. Currently, the proceedings have advanced to the stage of arguments on charges. Despite being offered the option of attending via video conferencing (VC), Chadha’s consistent failure to appear in person drew criticism from Magistrate Arora.

She remarked,

“It appears that accused Sanjeev Chadha has a habit of avoiding his physical appearance at one pretext or another. The same can be perused from the court file,”
the court said.

In an order issued on February 19, the magistrate condemned Chadha’s reliance on video conferencing as an abuse of the legal process.

The Court observed that the accused is abusing the process of law by appearing through VC.

“Seeing the conduct of accused Sanjeev Chadha, a cost of ₹ 30,000 stands imposed upon him to be paid in DLSA North-West, the court ordered on February 19, 2024,”
the Court said.
