Since the offence is bailable, Additional Chief Judicial Magistrate Tanya Bamniyal granted bail to Marlena, requiring her to submit a bail bond of Rs 20,000 and one surety of the same amount.

NEW DELHI: Today (23rd July): A Delhi court granted bail to Delhi Minister Atishi Marlena in a criminal defamation case filed by BJP media head Praveen Shankar Kapoor. Kapoor accused Atishi of making allegations against the BJP regarding poaching Aam Aadmi Party (AAP) MLAs.
Since the offence is bailable, Additional Chief Judicial Magistrate Tanya Bamniyal granted bail to Marlena, requiring her to submit a bail bond of Rs 20,000 and one surety of the same amount.
While summoning Atishi, the court remarked,
“It appears that the accused, Atishi, through her spoken and written words, has made defamatory statements that, on the face of it, have tarnished the complainant’s reputation among reasonable members of society. These statements seem to have been made with the intent to harm the complainant’s reputation.”
The court further noted that the testimonies of the complainant’s witnesses suggest that Atishi’s statements were prima facie defamatory.

Marlena appeared in court physically, and her lawyers, senior advocates Ramesh Gupta and Shailendra Singh, requested additional time to review the documents before proceeding with arguments.
The case is scheduled for further hearing on August 8. Kapoor had approached the court on April 29, alleging that AAP and its leaders made accusations against the BJP after the CBI and ED initiated an investigation into the now-abandoned Delhi liquor excise policy.
The court issued summons to Atishi on May 28, based on the complainant’s testimonies, but did not issue any summons to Delhi Chief Minister Arvind Kejriwal. The court noted that Atishi’s statements appeared to be defamatory and intended to harm Kapoor’s reputation.

Kapoor had previously sent a defamation notice to Atishi in April, following her claims that she had been offered a chance to join the BJP or face arrest by the ED.
