Court Orders BJP Leader to Reply to Delhi CM Atishi's Defamation Case Plea

Today, on October, 7th, the Rouse Avenue court has directed BJP leader Praveen Shankar Kapoor to submit a reply to a revision petition filed by Delhi CM Atishi in a defamation case. Atishi has challenged the summoning order issued in the defamation suit filed by Kapoor. Special Judge Vishal Gogne scheduled the matter for arguments on October 23 and 24.

New Delhi: The Rouse Avenue court has directed BJP leader Praveen Shankar Kapoor to file a reply to a revision petition moved by Delhi Chief Minister Atishi in a defamation case. Atishi had earlier challenged the summoning order in a defamation complaint filed by Kapoor. Special Judge Vishal Gogne has listed the matter for arguments on October 23 and 24.

On the previous hearing, the court had issued a notice to Kapoor in connection with the case.

The defamation complaint was filed by Kapoor after Atishi made public claims that BJP had approached her through a close intermediary, urging her to join the party. The Rouse Avenue court had issued summons to Atishi on May 28, following which she was granted bail on July 23, after appearing in person and furnishing a bail bond. Meanwhile, the Additional Chief Metropolitan Magistrate has adjourned the case until November 5, as the appellate court has called for the case records.

Senior advocates Ramesh Gupta and Shailendra Singh represented Atishi, while senior advocate Ajay Burman, along with Shoumendu Mukherjee, appeared for Kapoor. Before filing the defamation suit, Kapoor had sent a legal notice to Atishi, accusing her of making false and defamatory statements during an April 2 press conference. The notice alleged that Atishi’s claims were intended to malign the reputation of the BJP and its members.

The legal notice said,

“In the entire speech, she neither revealed specific information about the source of information nor you have given any details qua the act of BJP the act of BJP. Devoid of any specifies your statement is an intentional endeavour to reflect your own imagination and apprehension,”

The notice demanded that Atishi retract her statement and publicly apologize through television and social media. Atishi, the AAP leader and Delhi Minister, alleged that the BJP approached her to join their party, threatening her with arrest by the Enforcement Directorate if she refused.

During a press conference, she claimed,

“The BJP, through one of my close aides, approached me to join their party to save my political career, and if I do not join the BJP, then in the coming month, I will be arrested by the ED.”

Atishi accused the BJP-led central government of attempting to intimidate her party through investigative agencies.

She added,

“I want to tell the BJP that we will not be scared of you. We are the soldiers of Arvind Kejriwal. We are aides of Bhagat Singh. We will continue to save the Constitution and will work to give the people a better life under the leadership of Arvind Kejriwal,” 

She also claimed that, in the lead-up to the general elections in the next two months, several other leaders, including Raghav Chadha and Saurabh Bharadwaj, are likely to face arrest by the central investigative agency. Atishi’s accusations highlight her concerns over political intimidation tactics employed ahead of the elections.
