Delhi court refused bail to Ajay Kumar Nayyar, accused of cheating Rs 3.9 crore by pretending to be Amit Shah’s nephew. He allegedly promised a fake Rs 90 crore government tender.
Thank you for reading this post, don't forget to subscribe!NEW DELHI: A court in Delhi has refused to give bail to a man named Ajay Kumar Nayyar. He is accused of cheating someone by pretending to be the nephew of Union Home Minister Amit Shah.
This decision was made by Delhi’s Patiala House Court on Tuesday.
As per the case details, Ajay Kumar Nayyar told the complainant that he could help him get a government tender worth Rs 90 crore. In return, the complainant gave him Rs 3.9 crore through both cash and RTGS (bank transfer).
Ajay Nayyar has been in jail since 10th November 2021.
His bail application was heard by Additional Sessions Judge Dr. Hardeep Kaur.
The judge rejected the bail request and said:
“Considering the seriousness of the allegations and gravity of the offence, this Court is not inclined to release the applicant/accused on bail. Therefore, the present bail application stands dismissed.”
The court also said:
“Accused had played an active role in the commission of the crime by impersonating himself as the nephew of the Union Home Minister and assured the complainant of getting a big tender of Rs 90 crore and received Rs 3.9 crore through cash and RTGS from the complainant.”
While reviewing the bail plea, the court noted that the accusations were very serious.
It added:
“Allegations against the accused are grave in nature. It is clear from the record that the testimony of the complainant is not concluded; his cross-examination is still going on.”
The Public Prosecutor told the court that the complainant is still supporting the case made by the prosecution. It was also brought to the court’s attention that Ajay Nayyar has been in custody for over 3 years (39 months).
The investigation is already over and a charge sheet has been filed. The lawyer also pointed out that other accused in the case were already granted bail.
However, the court did not accept this argument and explained:
“Further, the accused cannot claim bail on the ground of parity, as it is evident from the record that the role of the applicant/accused is different from that of co-accused persons who have already been enlarged on bail.”
The judge also added more details on why the court did not grant bail.
The order stated:
“The period of custody and filing of a charge sheet in such cases is not itself a ground for bail, whereas the court has to consider other factors like the nature and gravity of the accusation, the severity of punishment, and the danger of the accused absconding or fleeing; the character, behaviour, means, position and standing of the accused; the likelihood of the offence being repeated; reasonable apprehension of a witness being influenced/threatened; and the danger, of course, of justice being thwarted by the grant of bail.”
According to the police, this case started from a complaint made by a person named Gursimerdeep Singh. He owns a leather business called M/s Jalandhar Leather India Pvt Ltd. In June 2020, one of his family friends, Amit Talwar, introduced him to Ajay Kumar Nayyar at the Jalandhar Gymkhana Club.
At that meeting, Nayyar claimed he was the nephew of Amit Shah. He promised Singh that he could arrange a big government order (tender) worth Rs 90 crore. This tender was said to be for supplying leather for the renovation of the Rashtrapati Bhawan (President’s Estate).
