A Delhi father moves court seeking an FIR after his minor daughter was allegedly converted to Islam, raped, and buried without consent, raising serious questions over forced religious conversion.

Background of the Case
The complainant, a Hindu man, claims his wife deserted him eight years ago, taking along their two minor children, a son and a daughter. According to the plea filed in court, the woman then entered into a relationship with a Muslim man and converted to Islam, along with the children.
The rise of the father’s grievance allegedly followed, claiming that his minor daughter was sexually harassed, physically assaulted, raped, and ultimately murdered while living with the man his estranged wife had moved in with. These accusations are extremely grave and have shaken the conscience of those following the case.
Religious Conversion & Legal Custody
The case raises critical questions about the religious conversion of minors without the consent of the biological father, who, at the time, retained legal ties to his children. While the Indian legal system has upheld the freedom of religion, the conversion of children, especially in the absence of a mutual custodial agreement, lacks a clear guideline.
It is unclear whether any formal guardianship proceedings took place when the mother converted and relocated with the children. If not, this raises questions about the legitimacy of the conversion, especially since minors are not considered to have attained the age of consent under Indian law, religious or otherwise.
The father alleges that he only learned about his daughter’s death from a relative, and when he rushed to the mortuary, he found visible injuries on her body. Distressingly, when he demanded the body be handed over for last rites as per Hindu customs, he claims he was threatened by the accused.
According to the complaint, the body was ultimately buried as per Islamic customs, allegedly without any legal clearance or consent from the biological father. This raises serious concerns about religious identity being used to override parental rights, particularly in death-related rituals where both religion and emotion converge deeply.
Court’s Action
Advocates Amita Sachdeva and Parth Yadav, representing the complainant, have urged the court to take immediate action. In response, Judicial Magistrate First Class (JMFC) Ayushi Saxena at Karkardooma Court has called for a status report from the SHO of Jagat Puri Police Station, and the matter is now listed for hearing on August 7.
Despite repeated efforts by the complainant, including written emails to the SHO and DCP, no FIR has been registered to date. The father now seeks a court direction for the registration of the FIR and a search to locate the burial site of his daughter’s body, so he can reclaim the right to mourn and bury her according to his faith.
