Yesterday, On 6th July, Arvind Kejriwal’s request for his wife to be present during his medical check-up denied. The court ruled that the request contradicts established prison regulations. According to the court, allowing such an exception would set a precedent against the rules. Consequently, the plea dismissed to maintain the integrity of the prison system.
New Delhi: The Delhi court, On Saturday, turned down Chief Minister Arvind Kejriwal‘s request to have his wife, Sunita Kejriwal, participate via video conferencing during his medical consultation with the board.
The court noted that Kejriwal’s request inconsistent with prison regulations.
Emphasizing that other inmates receiving treatment are similarly not allowed to have an attendant present the court stated,
“There is no reason to carve out an exception for Arvind Kejriwal by going against the Prison Rules,”
The court approved Kejriwal’s petition for access to his medical records, instructing jail officials to supply documentation of his doctor visits and consultations to his wife.
Additionally, the court permitted Sunita Kejriwal to directly contact the relevant medical board or doctors.
The court stated,
“She may have a meeting or consultation with them to discuss the preparation method of Kejriwal’s medically prescribed diet, if permitted under the hospital rules.”
On June 26, the Chief Minister of Delhi, Arvind Kejriwal, arrested by the Central Bureau of Investigation (CBI) while he was already in judicial custody at Tihar Jail. This custody in connection with a money laundering case filed by the Enforcement Directorate (ED) related to the now-scrapped excise policy.
Previously, on March 21, Kejriwal had been arrested by the ED at his official residence in Delhi. However, on June 20, the trial court granted him bail in the money laundering case. But a day later, the High Court stayed the trial court’s bail order.
As a result of these developments, the court extended Kejriwal’s judicial custody until July 12, as he remained embroiled in the legal proceedings surrounding the money laundering allegations.
The court’s decision influenced by several factors, including maintaining the standard protocols of medical privacy and the operational procedures of the correctional facility. The judge emphasized that the existing medical team is fully capable of providing the necessary care without external involvement.
Furthermore, the court highlighted that the correctional facility’s rules are designed to maintain order and security, which could be compromised by permitting family members to attend medical consultations.
