A Special Judge in Agra has set aside the lower court’s order dismissing a sedition complaint against MP and actress Kangana Ranaut. The court directed a fresh hearing after finding procedural lapses in the earlier dismissal.
A revision petition has been accepted in a case against Bollywood actress and Member of Parliament Kangana Ranaut, after a lower court earlier dismissed a criminal complaint accusing her of making derogatory and seditious remarks against farmers and freedom fighters.
The Special Judge (MP-MLA Court), Lokesh Kumar, has now set aside the lower court’s order dated May 6, 2025, and sent the matter back for a fresh hearing on its merits.
The court ruled that the earlier dismissal was not legally proper and that the lower court had failed to follow certain mandatory legal procedures.
The case began on September 11, 2024, when Advocate Ramashankar Sharma, President of the Rajiv Gandhi Bar Association, filed a complaint in an Agra court against Ms. Ranaut.
According to the complaint, the actress made “highly objectionable and derogatory statements” during a media interview on August 26, 2024, and in subsequent social media posts.
The petitioner alleged that Ms. Ranaut referred to protesting farmers as “rioters” and “terrorists”, which insulted the farming community.
It was also alleged that she made “seditious remarks” and insulted freedom fighters, including Mahatma Gandhi. Advocate Sharma requested the court to register a criminal case against her, including charges of sedition.

On May 6, 2025, the lower court dismissed the complaint, holding that the allegations were insufficient to proceed with a criminal case. Following this, Advocate Sharma filed a revision petition before the Special Judge (MP-MLA), challenging the legality and correctness of that dismissal order.
During the hearing, arguments were presented by both sides.
The petitioner’s counsel argued that the lower court’s order
“was not legally sound (‘nyaya sangat’)” and that it had “dismissed the suit prematurely and without properly considering the evidence submitted.”
The lawyer further claimed that the lower court had “overlooked procedural requirements” while rejecting the complaint.
On the other hand, Ms. Kangana Ranaut’s counsel, which included advocates from the Supreme Court, opposed the revision petition. They defended the lower court’s decision, arguing that the dismissal was justified and in line with legal provisions.
After hearing both sides on November 10, 2025, and reserving the decision, Special Judge Lokesh Kumar delivered his order on Wednesday, November 12, 2025. The court allowed the revision petition filed by Advocate Sharma, setting aside the earlier order.

In his judgment, the Special Judge observed that the lower court had “overlooked certain mandatory provisions,” reportedly referencing Section 225(1) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, while dismissing the complaint.
The court directed the lower court to
“re-hear the complaint based on the existing facts and evidence on record and to proceed in accordance with the law.”
As a result, the matter has now been remitted back to the lower court for a fresh hearing, where the case will be reconsidered on its merits. The next hearing in the case is scheduled for November 29, 2025.
