AAP leader Satyendar Jain challenged a trial court’s order that refused to take cognizance of his complaint against BJP MP Bansuri Swaraj. Jain had filed a complaint alleging defamation and false statements by Swaraj. The trial court dismissed the plea, stating insufficient grounds for action. Jain has now moved a higher court, seeking a review of the decision.

New Delhi: AAP leader and former Delhi Minister Satyender Jain has filed a revision against the trial court’s decision that refused to take cognizance of his defamation complaint against BJP MP Bansuri Swaraj.
The Sessions Court at Rouse Avenue has scheduled the matter for consideration on March 12, and has summoned the trial court records for review.
The revision petition, submitted through advocate Rajat Bhardwaj, follows Jain’s earlier defamation complaint against Swaraj, who allegedly made defamatory statements about him in connection with an ED raid.
On February 20, 2025, Additional Chief Judicial Magistrate (ACJM) Neha Mittal declined to consider Jain’s complaint, which claimed that Swaraj had made damaging remarks during a television interview on October 5, 2023.
Jain contends that Swaraj’s statements, which included false claims of Rs.3 crores, 1.8 kgs of gold, and 133 gold coins being recovered from his residence, were intended to damage his reputation and provide her with political leverage.
He accused her of labeling him as “corrupt” and “fraudulent,” asserting that the false and malicious allegations have severely impacted his reputation both as a public figure and in his personal life.
The court had previously issued a pre-summoning notice to both the BJP MP and the news channel involved, allowing for the presentation of pre-summoning evidence.
During a hearing on January 13, the counsel for Swaraj argued that Jain’s complaint was politically motivated and intended for electoral gain, while Jain was in custody related to the same matter, with his bail applications having been rejected.
Advocate Siddhesh Kotwal maintained that Swaraj’s statements were based on publicly available information and court observations.
Satyender Jain had filed a defamation lawsuit against Bansuri Swaraj, alleging that she made defamatory remarks about him during a television interview in October 2023. He claims that the statements made during the interview were false and harmed his reputation.
Earlier, on December 11, 2024, Senior Civil Judge Naina Gupta had issued a notice to Bansuri Swaraj and other respondents, asking them to respond to the suit.
Jain has demanded that the TV channel remove the interview from its platform. He has also requested the court to prevent Bansuri Swaraj from making any more such statements. As part of the defamation claim, Jain has sought symbolic damages of one rupee.
Apart from the civil defamation suit, Jain had also filed a criminal defamation case against Bansuri Swaraj in Rouse Avenue Court. However, this criminal case was dismissed by the court.
