NEW DELHI: AAP MLA Amanatullah Khan has been granted anticipatory bail by a Rouse Avenue court, on Tuesday (25th Feb) in a case related to obstructing police officials during an arrest.
Special Judge Jitendra Singh had earlier given Amanatullah Khan protection from arrest until Monday, which was later extended for one more day. The case involves allegations that Khan obstructed police personnel who were trying to arrest Shahwez Khan, an alleged proclaimed offender.
The judge scheduled the matter for a hearing on arguments from both the prosecution and the defense on February 25.
Delhi Police sought Khan’s custody to interrogate him and determine whether he was present at the scene of the alleged attack.
The police also submitted CCTV footage and witness statements as evidence before the court.
The judge stated that certain clarifications were needed before passing an order.
“Time is required to review the CCTV footage presented by the investigating officer to understand the nature and gravity of the allegations. The matter is listed for clarification and order on February 25, 2025. Meanwhile, the prosecution is directed to submit a list of pending cases against the applicant along with their status. The interim order shall remain in effect until the next hearing,” the judge said.
Delhi Police registered an FIR against the Okhla MLA on February 10, alleging that he led a mob to aid a proclaimed offender—accused in an attempt-to-murder case—in escaping custody.
According to the police, the incident took place when the Crime Branch attempted to arrest Shabaz Khan.
On February 13, the court “prima facie” noted that
“the police team’s allegation that the applicant played a key role in facilitating the accused’s escape does not appear to hold weight, as the accused had already been granted anticipatory bail in July 2018 in the case for which the police allegedly sought to arrest him.”
