A special court in Mumbai, under the National Investigation Agency (NIA) Act, on Monday extended its own order to temporarily suspend the bailable warrant issued to former BJP MP Sadhvi Pragya Singh Thakur in the 2008 Malegaon blast case. Earlier this month, Pragya Thakur’s lawyer submitted that she was undergoing treatment at a Meerut hospital and would remain present in court on or before December 30, 2024.

MAHARASHTRA: A special court in Mumbai, working under the National Investigation Agency (NIA) Act, has once again extended its earlier order to temporarily suspend the bailable warrant issued against former BJP MP Sadhvi Pragya Singh Thakur.

This case is related to the 2008 Malegaon blast.

The court had previously issued a bailable warrant against Sadhvi Pragya Singh Thakur because she did not appear before the court during the ongoing trial, which is now nearing its conclusion.

On December 2, the court learned that the bailable warrant could not be served because Thakur was not found at her residence. Upon further inquiry, it was revealed that she was undergoing medical treatment at Meerut’s Hospital & Institute of Integrated Medical Sciences.

On December 3, her advocate, JP Mishra, informed the court that Thakur was still undergoing treatment. He explained that according to the doctors’ advice, she would be able to travel in three to four weeks.

“She would remain present on or before December 30, 2024,”

-Mishra assured the court.

After hearing these details, the court decided to temporarily suspend the bailable warrant.

On December 30, Advocate JP Mishra told the court that Thakur had returned from the medical facility and had even booked tickets to travel to Mumbai from Bhopal. However, Mishra stated,

“She came down with typhoid, high fever, and abdominal pain.”

He also submitted a medical certificate to support this claim. He further added,

“As per the doctors’ advice, she would be able to attend the court after January 12, 2025.”

Taking these submissions into account, the special court extended the suspension of the bailable warrant.

The trial in the 2008 Malegaon blast case is now in its final stages, with the court recording the statements of the seven accused.

The tragic blast occurred on September 29, 2008, when a motorcycle with an explosive device exploded near a mosque in Malegaon, a town in Maharashtra about 200 km from Mumbai. The incident claimed the lives of six people and injured more than 100 others.

Sadhvi Pragya Singh Thakur, Army officer Lieutenant Colonel Prasad Purohit, and five others are accused of being part of the conspiracy behind the blast. They are being tried under the Unlawful Activities (Prevention) Act (UAPA) and the now-defunct provisions of the Indian Penal Code (IPC).

Initially, Maharashtra’s Anti-Terrorism Squad (ATS) was responsible for investigating the Malegaon blast case. However, in 2011, the case was handed over to the National Investigation Agency (NIA) for further probing.
