US attack on Iran’s nuclear sites violates international law: Asaduddin Owaisi | ICJ role in this?

AIMIM chief Asaduddin Owaisi condemned the US strikes on Iran’s nuclear sites, calling them a breach of international law and the US Constitution. His remarks come amid global concerns over rising Middle East tensions.

Hyderabad: Today, on June 22, in a major and sudden escalation in the ongoing tensions in the Middle East, the United States has officially joined Israel’s campaign against Iran.

The US launched powerful airstrikes on three major nuclear sites in Iran — Fordow, Natanz, and Esfahan. These locations are known to be critical parts of Iran’s nuclear enrichment program.

Former US President Donald Trump later confirmed the airstrikes through a post on his platform, Truth Social.

He described the military action as a huge success and said,

“spectacular military success,” claiming that “Iran’s nuclear enrichment infrastructure had been completely and totally obliterated.”

He also added a serious warning for Iran, stating,

“Make peace or face greater and easier attacks.”

Trump also referred to the event as a “historic moment” for the United States, Israel, and the world.

The US attack marks a new chapter in the Iran-Israel conflict, with the situation becoming more dangerous and global in nature due to America’s direct involvement.

The airstrikes have raised serious legal and diplomatic questions globally.

Indian political leaders reacted strongly and critically to this development. All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi condemned the US strikes and said,

“The strikes carried out this morning by the US on nuclear sites in Iran are a violation of international law, and even of the US Constitution itself.”

Congress leader Pramod Tiwari also criticized the United States for launching attacks on Iran, a country that has supported India in the past.

He said,

“The world operates on international laws, and violating the sovereignty of any nation is a serious crime. The US is carrying out bombings from so far away, I just want to say that such actions were taken against our neighboring country, like Iran, who have stood with India during difficult times, is not good and on the other side, our government is silent on all this.”

Rashtriya Janata Dal (RJD) MP Manoj Jha also shared his thoughts on the issue and pointed towards the rising global tension.

He said,

“The entire world is going through a period of great turmoil, and the US President has played a significant role in shaping this situation.”

Shiv Sena (UBT) MP Priyanka Chaturvedi took a more sarcastic approach to comment on the growing partnership between the US and Israel.

Taking a dig at former US President Donald Trump’s alignment with Israeli Prime Minister Netanyahu, she said,

“America voted for President Trump but got Netanyahu as their boss.”

Decades of Tension: Understanding the Iran-Israel-US Conflict

The current crisis did not emerge overnight. The long-standing tension between Iran and Israel dates back decades, rooted in deep political, religious, and strategic differences.

Iran has consistently opposed Israel’s legitimacy as a state, while Israel sees Iran’s growing nuclear capabilities as a direct threat to its national security.

Over the years, Israel has allegedly carried out covert operations such as sabotage and assassinations of Iranian nuclear scientists to delay Tehran’s nuclear ambitions.

The United States’ role in this conflict is tied to its historic alliance with Israel and its own concerns about Iran’s nuclear program.

After the 2015 Iran Nuclear Deal (JCPOA)—which aimed to limit Iran’s nuclear activities in exchange for sanction relief—was abandoned by former President Donald Trump in 2018, tensions flared.

Iran resumed uranium enrichment beyond permitted levels, triggering fears of nuclear weapon development. The recent US airstrikes indicate a sharp military escalation, shifting from diplomacy to direct confrontation.

Violation of International Law and Role of the ICJ

From an international legal standpoint, these actions raise serious concerns. According to Article 2(4) of the United Nations Charter, member states are prohibited from using force against the territorial integrity or political independence of any state.

The only exceptions allowed are self-defense under Article 51 or action authorized by the UN Security Council. Neither of these justifications have been officially provided in this case.

The Geneva Conventions and customary international humanitarian law also apply if there is armed conflict, and target selection must comply with principles of distinction, proportionality, and necessity.

Striking civilian infrastructure or engaging in disproportionate military action can amount to war crimes.

In terms of legal recourse, the International Court of Justice (ICJ)—the principal judicial organ of the United Nations- has the authority to adjudicate disputes between nations, including violations of international law.

However, the ICJ can only hear a case if both parties consent to its jurisdiction. Iran could approach the ICJ against the United States, alleging violation of its sovereignty and unlawful use of force, but enforcing ICJ judgments remains a challenge without cooperation from all parties involved.
