New Delhi, May 23 — The Supreme Court on Thursday heard concerns raised by Senior Advocate Dr. Adish Aggarwala about alleged irregularities in the recent elections of the Supreme Court Bar Association (SCBA).
The matter was brought up during the hearing of the SCBA v. BD Kaushik case before a Bench comprising Justice Surya Kant and Justice NK Singh.
Dr. Aggarwala informed the Bench that there were serious discrepancies in the election results.
According to him, “There were 200 extra votes compared to the actual polled votes.”
He further said that despite the issue being raised, the concerned authorities continued with the process without addressing the problem.
He reminded the court that, “They didn’t wait despite… yesterday, Your Lordships had said if anyone has concerns…”
In response, Justice Surya Kant advised Dr. Aggarwala to wait for the appropriate bench to take up the matter.

He stated, “Wait for the special bench… check when Justice Viswanathan is available—I’ll sit that week.”
Emphasising that the matter did not require immediate hearing, he remarked, “There’s no urgency for listing today. It’s not an earth-shattering matter.”
Dr. Aggarwala persisted, stressing the seriousness of the situation.
He said, “The individual holding the President’s post is ineligible…to be the president.. do something mylord.”
Justice Surya Kant assured that appropriate steps would be taken if the allegations were proven.
He said, “If convinced, we will annul the election. Submit a formal application and serve it to the opposing side—with a supporting affidavit.”
Justice Surya Kant has indicated that a special bench, including Justice Viswanathan, will take up the matter at a later date. Dr. Aggarwala has been asked to file a formal application and provide a sworn affidavit to support his claims. The Supreme Court made it clear that due process will be followed and the allegations will be thoroughly examined.
