Rajya Sabha MP Abhishek Singhvi: “Judiciary May Declare Waqf Amendment Bill Unconstitutional”

Rajya Sabha MP Abhishek Singhvi expressed concerns that the judiciary might declare the Waqf Bill “unconstitutional.” The bill seeks to address flaws in the previous law and improve the functioning of Waqf boards. It aims to streamline the registration process and enhance transparency. Additionally, it promotes the use of technology for better management of Waqf records.

Rajya Sabha MP Abhishek Manu Singhvi stated on Friday that the Waqf Amendment Bill 2025 could be deemed “unconstitutional” if challenged in court.

Singhvi remarked,

“They have misused the majority and the bill has been imposed. If the bill is challenged, there is a big chance that the judiciary will declare it unconstitutional,”

DMK MP M M Abdulla called it a “black day” for democracy and for minorities.

Abdulla added,

“We have shown our solidarity and our strength. The Chief Minister (MK Stalin) has already announced that he will move this to the court,”

SP MP Ramji Lal Suman expressed his concerns, stating,

“The bill has been passed as the government had the numbers… Their intention is not right…”

The Parliament approved the Waqf Amendment Bill 2025 in the early hours of Friday following an extended and intense debate. Rajya Sabha Chairman Jagdeep Dhankhar confirmed the vote with “Ayes 128 and Noes 95, Absent zero. The Bill is passed.”

Additionally, the Mussalman Wakf (Repeal) Bill, 2024, was also passed during this late-night session.

Union Minority Affairs Minister Kiren Rijiju accused opposition parties of misleading the public regarding the Waqf Amendment Bill, asserting that it will benefit millions within the Muslim community.

In response to the lengthy debate in the Rajya Sabha, Rijiju noted that many suggestions from the Joint Parliamentary Committee were incorporated into the revised bill.

The Lok Sabha had discussed the Waqf (Amendment) Bill on Wednesday, ultimately passing it just past midnight after a protracted debate. Rijiju announced that the Waqf (Amendment) Bill 2025 will be renamed the UMEED (Unified Waqf Management Empowerment Efficiency and Development) Bill.

The government introduced this revised bill after considering the recommendations of the Joint Parliamentary Committee, which reviewed the original legislation proposed in August of last year.

The bill aims to amend the 1995 Act, enhancing the administration and management of waqf properties in India.

Its objectives include addressing the shortcomings of the previous legislation and improving the efficiency of Waqf boards, streamlining the registration process, and increasing the use of technology in managing waqf records.
