Maharashtra’s top law officer Birendra Saraf has resigned citing personal reasons, CM Devendra Fadnavis confirmed. He will remain in office till January 2026 while the government finds his successor.
Mumbai: Maharashtra Advocate General Birendra Saraf has resigned from his post, informing that he is stepping down due to personal reasons. His resignation was placed before the state Cabinet on Tuesday, September 16, 2025, where Chief Minister Devendra Fadnavis informed the ministers that the resignation has been accepted.
Although the resignation has been accepted, Saraf will continue working as Advocate General till January 2026.
This gives the government some time to decide and appoint a new person for the important position of Advocate General of Maharashtra.
Birendra Saraf was appointed as Advocate General in December 2022. Since then, he has represented the Maharashtra government in many crucial and high-profile cases.
Some of the most important matters where he appeared include the Maratha reservation issue and the Badlapur school sexual assault case.
His legal arguments and court appearances in these sensitive matters made him one of the most visible law officers of the state during his tenure.
Saraf is a senior lawyer with nearly 25 years of practice in the Bombay High Court. He was designated as a Senior Advocate in February 2020.
A graduate of the prestigious Government Law College, Mumbai, he has built a strong reputation in the legal fraternity for his deep understanding of constitutional and administrative law.
With his resignation, the Maharashtra government now has the challenge of finding his replacement in the coming months.
The Advocate General is the highest law officer of the state and plays a critical role in advising the government, appearing in important cases before the High Court and the Supreme Court, and defending the state’s policies and decisions in court.
Saraf’s decision to step down marks a significant change in the state’s legal set-up. While he will continue till January 2026, the search for a new Advocate General will be closely watched in the political and legal circles of Maharashtra.
