Videos circulating on social media show him discussing provocative issues, including a statement suggesting that “law works according to the majority.” The remarks have sparked debate and raised concerns over judicial neutrality. The collegium is expected to address the matter soon.

New Delhi: Justice Shekhar Kumar Yadav of the Allahabad High Court set to appear before the Supreme Court collegium to address controversy stemming from his remarks at a Vishwa Hindu Parishad (VHP) event.

The Supreme Court Collegium requested Justice Shekhar Kumar Yadav of the Allahabad High Court to appear in person and clarify his comments suggesting that the country should operate according to “the majority’s wish” made at an event earlier this month.

Sources indicate that the collegium, led by Chief Justice of India Sanjeev Khanna, will convene on Tuesday, December 17, to discuss this issue before the Supreme Court’s winter recess.

According to various media reports, during the event on December 8, Justice Yadav stated that the primary goal of the Uniform Civil Code is to “promote social harmony, gender equality, and secularism.”

However, his comments on “law working according to majority” have sparked widespread criticism, particularly his claim,

“This is Hindustan, and this country would function as per the wishes of the ‘bahusankhyak’.”

An official statement noted that the Supreme Court is reviewing reports of his speech and has requested details from the high court. It is customary for a judge facing scrutiny to present their side to the collegium, led by the Chief Justice of India.

Opposition leaders have condemned his reported statements as “hate speech.” On Friday, over 55 MPs from the Rajya Sabha filed a notice for his impeachment.

The comments made by the sitting judge has led to demands that he be impeached and judicial work be withdrawn from him in the meantime.

The Campaign for Judicial Accountability and Reforms (CJAR) has filed a formal complaint with the Chief Justice of India (CJI) demanding an in-house enquiry against Justice Yadav.

Notably, on December 12, Allahabad High Court announced a major change in the roster of Justice Yadav. Effective December 16, he will only be hearing first appeals cases arising out of orders passed by district courts, and that too only those filed up to 2010. 

Senior lawyer Prashant Bhushan has urged the Chief Justice to initiate an “in-house inquiry” into Justice Yadav’s conduct, emphasizing the need for a robust institutional response to maintain public trust in the judiciary.

Bhushan’s letter called for the establishment of an inquiry committee and the withdrawal of all judicial responsibilities from Justice Yadav to restore faith in the judicial system.
