The development follows a directive issued by the President of India on December 12, 2025, asking Justice Nisha Banu to assume charge at the Kerala High Court on or before December 20, 2025. This direction came after the Judge did not join the Kerala High Court despite the Centre notifying her transfer on October 14, 2025.
Justice Banu’s transfer was recommended by the Supreme Court Collegium in August 2025, and the recommendation was subsequently accepted by the Union Government in October 2025, making the transfer official.
Controversy Surrounding Collegium Composition
The transfer gained further attention in the context of developments within the Madras High Court collegium. On November 9, 2025, the Madras High Court collegium recommended six District Judges for elevation. The Tamil Nadu Government returned the proposal, not questioning the suitability of the candidates, but seeking clarification on why Justice Nisha Banu was not included in the collegium, while Justice M.S. Ramesh, the next seniormost judge, was part of it.
This move triggered discussions within legal circles regarding seniority, collegium composition, and transparency in judicial appointments.
Adding to the controversy, around 50 lawyers of the Madras High Court had earlier written to the President of India, alleging that Justice Nisha Banu was intentionally delaying her joining at the Kerala High Court to continue as part of the Madras High Court collegium.
These allegations placed the transfer under intense public and institutional scrutiny, eventually leading to the President’s directive fixing a clear timeline for her assumption of charge.
