Opposition INDIA bloc may move an impeachment motion against Chief Election Commissioner Gyanesh Kumar after Congress accused the poll body of “large scale voter theft.” A senior leader said the move is “to underline their protest at the conduct of the CEC.”

The Opposition INDIA bloc is planning to bring an impeachment motion against Chief Election Commissioner (CEC) Gyanesh Kumar, according to sources quoted by The Hindu. This decision was taken during a meeting of the INDIA bloc floor leaders on Monday, August 18, 2025.

This major political step comes just a day after the Chief Election Commissioner held a press conference in New Delhi. The press conference was meant to counter the Congress party’s allegations against the Election Commission.

Congress had earlier accused the poll body of “large scale voter theft” and also alleged that

“the Commission is working in favour of the ruling party.”

As per the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, the Chief Election Commissioner can only be removed in the same way as a Supreme Court judge.

This means that Parliament has the power to remove the CEC, but only through a motion that must be passed with a two-thirds majority in both the Lok Sabha and the Rajya Sabha. For such a motion to even be introduced, at least 50 Members of Parliament have to sign in its favour.

However, the numbers in Parliament make this move extremely difficult for the Opposition. The INDIA bloc does not have the required strength to ensure the passage of such a motion.

Despite this, the parties are likely to proceed, because the intention is political rather than practical.

A senior Opposition leader explained the strategy clearly and said,

“the motion is to underline their protest at the conduct of the CEC.”
