[Defamatory Remarks] “Calcutta HC’s Restraining Order Against CM to be Challenged”: Mamata Banerjee’s Lawyer

Mamata Banerjee’s lawyer announced plans to challenge the Calcutta High Court’s restraining order against the Chief Minister. The issue arose after Governor Bose filed a defamation case against Banerjee on June 28.

Calcutta: After the Calcutta High Court‘s ruling to prohibit West Bengal Chief Minister Mamata Banerjee from making ‘defamatory‘ remarks against Governor C.V. Ananda Bose, Banerjee’s lawyer stated that she has the right to freedom of speech and that they will contest the order.

Sanjay Basu, Banerjee’s attorney, explained that the Chief Minister was voicing the concerns of many women who reached out to her.

On Tuesday, July 16, the Calcutta High Court issued an order preventing CM Banerjee and three others from “making any defamatory or incorrect statement against the plaintiff (Bose) by way of publication and on social platforms until August 14, 2024.”

Basu stated that the High Court’s order would be challenged.

Basu said,

“The Hon’ble Court has not determined or concluded that the statements challenged in the suit were defamatory or incorrect. The Hon’ble Chief Minister merely referred to the concerns of numerous women who have approached her. She has a right to freedom of speech, which is guaranteed under Article 19 of the Constitution of India,”

West Bengal Governor CV Ananda Bose initiated a defamation suit against Chief Minister Mamata Banerjee at the Calcutta High Court, On June 28. Governor Bose filed a defamation case against West Bengal Chief Minister Mamata Banerjee after she claimed that women afraid to visit Raj Bhavan.

On May 2, a contractual female employee of Raj Bhavan accused Vose of molestation, prompting an investigation by the Kolkata police. TMC Rajya Sabha MP Dola Sen expressed her inability to comment without consulting the party leadership.

Basu added,

“As a public representative and a woman, she cannot ignore the perceived sufferings and grievances of women. Therefore, since the statements made by the Chief Minister have not been found to be defamatory, we believe that the order of general restraint on speech is unfounded,”

Governor Bose’s decision to pursue a defamation case reflects his intent to clear his name and address what he views as unfounded and damaging allegations. The high-profile nature of the case, involving two of West Bengal’s most prominent political figures, ensures that the proceedings will be closely watched.
