FIR Against Food Outlet ‘Lawyer’s Kitchen’: “Using Legal Symbols Disrespects the Legal Profession”

A Jaipur-based food outlet named Lawyer’s Kitchen is facing legal trouble after an FIR was filed for using legal symbols in its branding. Lawyers claim the use of such imagery disrespects the legal profession and could mislead the public.

Jaipur, Rajasthan, In a surprising turn of events, a new food outlet in Jaipur called A Lawyer’s Kitchen has found itself in legal trouble soon after its launch. Taking inspiration from popular branding ideas like Gujarat’s ‘MBA Chaiwala’ and Madhya Pradesh’s ‘Patrakar Pohewala’, the outlet tried to create a unique identity by using a law-related theme.

However, its use of specific legal imagery has created objections from the local legal fraternity.

The restaurant, based in the Mahesh Nagar area, styled its name using legal designs most notably, the letter “A” in “LAWYER’S” was shaped like the distinctive white neckband worn by advocates, and the “T” in “KITCHEN” resembled a judge’s gavel an emblem of judicial authority.

While these elements were meant to give the brand a law-inspired look, they ended up upsetting members of the legal community. Many lawyers raised objections, stating that using legal symbols for commercial purposes disrespected the dignity and seriousness of the legal profession. Following these complaints, an FIR was filed against the outlet’s owner at the Mahesh Nagar Police Station.

As per reports, an FIR has not only been registered, but the food outlet has also temporarily closed its operations amid the ongoing controversy. Legal action is expected to follow, with complainants claiming that the outlet’s branding misleads the public and diminishes the respect associated with the legal profession.

Legal experts believe this case highlights an important lesson for entrepreneurs: using symbols or themes linked to respected professions or institutions in branding can lead to serious consequences. It serves as a reminder to approach such creative choices with caution and awareness of their broader implications.

The core legal issue in this case revolves around the misuse of professional symbols, which can be seen as a violation of Section 505(2) of the Indian Penal Code (IPC), dealing with statements creating or promoting enmity, hatred, or ill-will. Although not directly applicable, it can be argued that the portrayal of such symbols in a commercial setup could lead to public misinterpretation.

Additionally, under the Advocates Act, 1961, only those enrolled with a State Bar Council can present themselves as legal professionals. While A Lawyer’s Kitchen is not pretending to offer legal services, the use of legal insignia may be seen as misleading or suggestive of a professional association, which is not permissible.

Legal experts also point to potential violation of Section 29 of the Trademarks Act, 1999, which prevents the use of misleading logos or marks that may cause confusion among the public.

This incident serves as a example for businesses to avoid using symbols tied to respected institutions, especially when such representations could lead to legal consequences or ethical concerns.
