Kochi: Lawyers from Kerala High Court today asked Justice A Badharudeen to say sorry publicly for how he behaved with a woman lawyer who recently lost her husband.
This matter happened on March 6. The woman lawyer asked the court to give her more time to change the vakalath because her husband had passed away in January.
Senior Advocate George Poonthottam and many other lawyers practicing in the Kerala High Court later called for an urgent meeting of the Kerala High Court Advocates’ Association (KHCAA) on this issue.
In their resolution, the lawyers said that Justice Badharudeen behaved very rudely and insensitively with the woman lawyer.
He even asked her,
“who is Alex Scaria?”
The lawyers said such behavior is not suitable for a judge and also disrespects the memory of the late Scaria. Therefore, they demanded that Justice Badharudeen should apologise publicly.
On this request, the KHCAA arranged an emergency meeting at 10 AM today. At the meeting, the lawyers decided to go together to Justice Badharudeen’s courtroom and ask him for a public apology.
But Justice Badharudeen did not apologise publicly.
According to sources, the lawyers, including KHCAA President Yeshwanth Shenoy, refused Justice Badharudeen’s offer to apologise privately in his chambers instead of in open court.
After that, the lawyers decided not to attend Justice Badharudeen’s court anymore.
Chief Justice Nitin Jamdar listened to the lawyers’ complaints today and promised that he would speak with Justice Badharudeen over the weekend to find a good solution.
This is not the first time lawyers have had complaints about Justice Badharudeen’s behaviour.
In February last year, both KHCAA and the Bar Council of Kerala wrote to the Chief Justice complaining that Justice Badharudeen’s interactions with lawyers were often humiliating and harsh. That letter was sent after Advocate Jayakumar Namboodiri TV was denied extra time even though he had a serious back injury.
To prevent bad behavior from both lawyers and judges in court, KHCAA earlier requested the Chief Justice to start compulsory video recording of all court proceedings.
Both letters also hinted that many other lawyers had similar complaints about Justice Badharudeen.
