The death of 26-year-old Bharat Bhushan Tiwari in a Bihar police encounter has sparked controversy and demands for accountability. A PIL filed before the Supreme Court seeks an independent probe, while the Bihar government has initiated a judicial inquiry into the incident.

The death of 26-year-old Bharat Bhushan Tiwari in a police encounter in Bihar’s Bhojpur district has become the centre of a major controversy, raising serious questions over the circumstances surrounding the use of force by law enforcement authorities. The incident has triggered political reactions, public debate and demands for an independent investigation into whether the police action was justified.
The matter has now reached the Supreme Court, where a public interest litigation (PIL) has been filed seeking an independent probe into Tiwari’s death. The development comes at a time when the Bihar government has already initiated a judicial inquiry to examine the circumstances of the encounter.
Who Was Bharat Bhushan Tiwari?
Bharat Bhushan Tiwari, aged 26, was a resident of Bilauti village in the Shahpur area of Bhojpur district. According to people familiar with him, Tiwari was known locally for using social media to highlight public issues affecting ordinary citizens. He frequently raised concerns related to flooding, river erosion and displacement faced by residents in the region. Through his Facebook posts, he attempted to bring attention to problems affecting local communities.
His family has claimed that Tiwari had no criminal background and was not involved in any unlawful activities. They described him as someone who spoke about social issues and community concerns rather than a person with criminal involvement. However, his death during a police operation has led to conflicting versions of events, with the police and his family presenting different accounts of what happened on the day of the encounter.
The Police Encounter: What Happened on June 17?
According to Bhojpur Police, officials received information on June 17 that Bharat Bhushan Tiwari was allegedly carrying a pistol and firing in a public area in Bilauti village. Following the information, a police team along with personnel from the Special Task Force (STF) reached the location.
The police claimed that Tiwari was repeatedly asked to surrender, but he allegedly continued firing at the team. According to the police version, the officers retaliated in self-defence and to ensure the safety of nearby residents.
The police further stated that STF personnel wearing bulletproof jackets moved towards Tiwari in an attempt to bring the situation under control. They alleged that Tiwari fired at the approaching team, leading to an exchange of fire.
During the incident, Tiwari sustained a gunshot injury to his leg. He was immediately taken to Patna Medical College and Hospital for treatment, where he later died. Police officials claimed that a pistol, two live cartridges, one magazine and two empty shells were recovered from the spot after the encounter.
The encounter later came under public scrutiny after videos circulated on social media allegedly showed Tiwari throwing away his weapon before the firing took place. However, the authenticity of these videos has not been independently confirmed. The emergence of the footage raised questions regarding the sequence of events and whether the situation could have been managed through alternative measures.
Concerns were also raised over whether the police followed all required procedures during the encounter and whether the use of lethal force was necessary under the circumstances.
Amid the growing controversy, Bihar Police suspended four personnel, including the concerned Station House Officer, while an inquiry into the incident continued. The action followed questions over the handling of the operation and allegations that officers may not have responded appropriately during the confrontation.
A purported video showing an armed suspect pointing a pistol towards security personnel also became part of the discussion, with allegations that there was a delay in the police response. The suspension and ongoing investigation are aimed at examining the conduct of the officers involved and determining whether any procedural lapses occurred.
Officials claimed that the police responded in self-defence after coming under attack. The police have maintained that the encounter was a response to an armed threat and that officers acted according to the situation they faced at the time.
Family Disputes Police Version, Alleges Wrongful Killing
The official account has been strongly challenged by Tiwari’s family members and several local residents. They have alleged that Tiwari had surrendered before the firing took place and that he was not posing any threat to the police personnel. According to the family’s claims, Tiwari had thrown away his weapon and was unarmed when the shots were fired.
The family has also pointed towards videos circulating on social media, claiming that the footage raises doubts about the police version of events. They have argued that if the allegations are correct, the incident may not have been a genuine encounter but a case of excessive use of force. The allegations have intensified demands for an impartial investigation to establish whether the police action followed legal procedures.
Bihar Government Orders Judicial Inquiry
Amid rising public anger and demands for accountability, the Bihar government announced a judicial inquiry into Bharat Bhushan Tiwari’s death. The inquiry will be conducted by a retired High Court judge and is expected to examine all aspects of the incident, including the sequence of events, the police response and the allegations raised by the family.
The government has also reportedly suspended four police personnel, including the concerned station house officer, while the investigation is underway. The purpose of the judicial probe is to determine the facts and ensure that any violation of law, if found, is addressed.
Case Reaches Supreme Court
The controversy surrounding the encounter has also reached the Supreme Court through a public interest litigation. The petition seeks a Central Bureau of Investigation (CBI) investigation into the death, along with registration of an FIR against the police personnel allegedly involved in the encounter.
It also seeks the formation of an independent committee headed by a retired Supreme Court judge to supervise the investigation and ensure transparency. The plea argues that if Bharat Bhushan Tiwari had surrendered before being shot, the incident could raise serious constitutional concerns and may amount to an extrajudicial killing.
The Supreme Court’s consideration of the matter is expected to bring further focus on the legal safeguards surrounding police encounters and the accountability mechanisms available when a person dies during police action.
Political Reactions and Larger Debate
The incident has triggered reactions from opposition parties, civil society groups and activists, many of whom have demanded a fair and transparent investigation. The case has once again brought attention to the broader debate surrounding police encounters in India, particularly the need to balance law enforcement powers with the protection of fundamental rights.
Supporters of police accountability have argued that every encounter death must be carefully examined to determine whether the force used was necessary and proportionate.
The controversy has also drawn reactions from within the ruling Bharatiya Janata Party (BJP), with several party leaders raising concerns over the manner in which the police operation was carried out. Bihar Deputy Chief Minister Vijay Kumar Sinha described the incident as “sad and unfortunate” and suggested that there appeared to have been administrative negligence in the handling of the situation. He stated that the government would ensure that no innocent person faces injustice and assured that strict action would be taken if any officials were found responsible for lapses.
Other BJP leaders, including Education Minister Mithilesh Tiwari, Rituraj Sinha and Buxar MLA Anand Mishra, also expressed concerns over the circumstances surrounding the encounter. Mithilesh Tiwari questioned whether alternative methods could have been adopted to control the situation, stating that if a non-lethal option was available, it should have been considered before using deadly force.
Rituraj Sinha termed Tiwari’s death unfortunate and emphasised that while maintaining law and order is essential, authorities responsible for protecting citizens must ensure that their actions remain within legal and ethical limits.
The incident also led to protests in Shahpur’s Bilauti village, where Tiwari’s family members and local residents gathered in large numbers. Protesters placed his body on the Ara-Buxar four-lane highway and blocked traffic as a mark of their opposition.
The demonstrators accused the police of carrying out a fake encounter and demanded a detailed and impartial investigation into the circumstances that led to Tiwari’s death. The protests further intensified pressure on authorities to ensure transparency and accountability in the ongoing inquiry.
The controversy surrounding Bharat Bhushan Tiwari’s death is now centred on a crucial question whether the incident was a lawful police response to an armed confrontation or whether the allegations of excessive force require further investigation.
As the judicial inquiry and proceedings before the Supreme Court move forward, the findings will determine the facts behind the encounter and whether any responsibility needs to be fixed.
