“Constitution Is a Beautiful Document, Almost Perfect Instrument; But Our Understanding & Implementation Are Imperfect”: Senior Advocate Dushyant Dave

Senior Advocates Dushyant Dave and KG Raghavan commended the Constitution and its framers during a conversation while waiting to mention the MUDA case in the Karnataka High Court. Dushyant Dave remarked that while the Constitution is flawless, issues lie in its understanding and implementation. The discussion highlighted the importance of adhering to the Constitution’s principles to address current challenges.

Senior Advocates Dushyant Dave and KG Raghavan praised the Constitution of India as a “perfect instrument” during a discussion while waiting to address a petition regarding the Muda scam in the Karnataka High Court.

On Constitution Day, Dave greeted Raghavan, who remarked that the Constitution is a “beautiful document” and an “almost perfect instrument,” though he acknowledged that no instrument can be entirely flawless.

Raghavan emphasized that the Constitution is what keeps the country functioning and expressed gratitude to Dr. B.R. Ambedkar and his colleagues in the Constituent Assembly, stating,

“But for them, we wouldn’t have been where we are today.”

He added,

“There’s no perfect instrument.”

In response, Dave asserted that while the Constitution is indeed a perfect document, its effectiveness relies on those who implement it, a point Dr. Ambedkar foresaw.

He remarked,

“It is our understanding and implementation that are imperfect. It is a joy to read the debates. What foresight and intellect.”

He further quoted Ambedkar’s warning about the dangers of a landslide election victory potentially leading to a dictatorship, stating,

“If a landslide (election victory) were to occur, it was quite possible for the democracy to retain its form but give place to dictatorship in fact.”

Later, Dave introduced a petition from activist Snehmayi Krishna, requesting a CBI investigation into the MUDA scam, mentioning that his client, Devaraju, the original landowner, is a respondent in the case.

He sought an adjournment since related matters had been postponed to December 5 by Chief Justice NV Anjaria. Consequently, Justice Nagaprasanna adjourned the hearing on Krishna’s plea to December 10.
