NEW DELHI: Chief Justice of India (CJI) DY Chandrachud, in a poignant address on the 78th Independence Day celebrations, highlighted the invaluable contributions made by Indian lawyers towards the country’s independence and the establishment of a robust judiciary. Speaking at the event organized by the Supreme Court Bar Association (SCBA) at the Supreme Court, the CJI reflected on the sacrifices and enduring impact of the legal fraternity in shaping modern India.
CJI Chandrachud began by paying homage to the numerous lawyers who gave up their profitable legal practices to dedicate themselves wholly to the struggle for India’s freedom. He emphasized the crucial role these lawyers played, not just in securing independence, but also in laying the foundation for a strong and independent judiciary.
“Many lawyers relinquished their prosperous legal practices and committed themselves to the national cause.”

The Chief Justice underlined that the role of patriotic lawyers did not cease with the attainment of independence. Instead, their commitment extended beyond, continuing to be a “constant force of good” in the nation. He acknowledged that the courts, along with the legal fraternity, are vital in upholding the rights and dignity of citizens, stating-
“The Courts are essential in safeguarding the rights and dignity of citizens. However, the Bar, committed to the Constitution and the rule of law, is crucial in preserving the moral compass of the Courts.”
In his speech, CJI Chandrachud highlighted the indispensable role that the Bar plays in the Indian judiciary. He described the Bar as a bridge that connects the people with the courts, ensuring that the judiciary remains aware of and responsive to the struggles of the common man.
“Members of the Bar serve as the vital bridge between the people and the judiciary, enabling us to understand and respond to the concerns and sentiments of the public.”

“Equally, the Bar is the representative of the profession and by extension of judges before the people. In that sense, the Bar is a two-way bridge between the people and the Court. An erudite and principled Bar makes for a vigilant and alert judiciary.”
This connection, the CJI asserted, ensures that the judiciary reflects the realities faced by ordinary Indians.
“I can sincerely say that the work of the courts mirrors the struggles of ordinary Indians as they navigate the challenges of their daily lives.”

He acknowledged the diverse array of litigants who approach the Supreme Court, seeking justice from all walks of life, and credited the legal community for enabling the courts to deliver justice effectively.
CJI Chandrachud also praised the legal community for its role in upholding and strengthening the Constitution of India. He noted that lawyers have been pivotal in rooting the Constitution on a firm basic structure, introducing substantive due process, and safeguarding the dignity of marginalized groups, including women, gender minorities, and LGBTQ+ individuals.
“Lawyers were crucial not only in securing India’s freedom but also in creating a robustly independent judiciary. However, their role did not end with Independence; lawyers and the Bar have continued to be a steadfast force for good in the country.”

He further reminded the legal community of its responsibility to maintain the moral conscience of Indian society and the courts, emphasizing that the Bar has played a significant role in steering many important constitutional and legal developments that align with the aspirations of India’s freedom fighters.
“The legal community has played a key role in establishing the Constitution’s firm foundation, advancing substantive due process, and safeguarding the dignity of women, gender minorities, LGBTQ+ individuals, and other marginalized groups.”

As the country marked 77 years of independence, CJI Chandrachud reflected on the progress India has made in various fields, including social justice, scientific development, economic prosperity, and political milestones. He expressed a deep sense of patriotism and gratitude towards the freedom fighters whose sacrifices have allowed India to flourish as a free nation.
“On Independence Day, every Indian, regardless of age or status, is filled with profound patriotism and gratitude towards our freedom fighters as they witness our majestic flag soaring high in the spirit of freedom.”
