The Bombay High Court granted bail to the juvenile accused on Tuesday, ordering his release into the care of his paternal aunt. The court ruled that the Juvenile Justice Board’s (JJB) remand orders were illegal and beyond its jurisdiction.

The bench consisting of Justice Bharati Dangre and Justice Manjusha Deshpande in response to a habeas corpus petition filed by the boy’s aunt, who sought his release from a government observation home.

The 17-year-old, son of real estate developer Vishal Agarwal, will now be under his aunt’s care as his parents and grandfather have been arrested for attempting a cover-up.

Initially, the Juvenile Justice Board (JJB) granted the teenager bail with a requirement to write a 300-word essay, a decision that drew significant public backlash. The police then requested a review, leading to the boy being remanded to an observation home. Authorities are seeking to have him tried as an adult.

Advocate Prashant Patil, representing the minor accused, explained that the child had been in custody since May 19, 2024, and was released on bail on May 22, 2024. However, the JJB took custody of the child again, which Patil argued was illegal. The High Court set aside the JJB’s remand orders, leading to the immediate release of the minor.
